RESOLUTION NO. 1999-792
RESOLUTION APPROVING THE MINOR SITE PLAN
AMENDMENT FOR WARREN TRANSPORT FOR PROPERTY
GENERALLY LOCATED AT THE SOUTHWEST CORNER OF
NEWELL STREET AND NORTH ELK RUN ROAD TO BUILD
A 60' X 60' ADDITIONAL BUILDING JUST TO THE
SOUTH OF EXISTING ACCESSORY BUILDING AND A
70' X 150' OFFICE BUILDING.
WHEREAS, it has been proposed that the Council of the City of
Waterloo, Iowa, approve a minor site plan amendment for Warren
Transport for property generally located at the southwest corner
of Newell Street and North Elk Run Road to build a 60' x 60'
additional building just to the south of the existing accessory
building and a 70' x 150' office building, and legally described
as follows :
That part of the East One-half (E ) of the
Northeast Quarter (NEk) of Section Twenty-one
(21) , Township Eighty-nine North (T89N) ,
Range Twelve West (R12W) of the Fifth
Principal Meridian in the City of Waterloo,
Black Hawk County, Iowa, lying North of the
Chicago Northwestern Railway Company right-
of-way, except the following described tract:
Beginning at a point on the North line of
said Northeast Quarter (NEk) which is One
Thousand One Hundred Seventy-one and Fifteen
Hundredths (1171 . 15) feet West of the
Northeast corner of said Northeast Quarter
(NEk) ; thence S 52°32' 21" E Six Hundred
Fourteen and Sixty-two Hundredths (614 . 62) ;
thence Southeasterly Two Hundred Eighty-three
and Thirty-eight Hundredths (283 . 38) feet
along a Six Hundred Twenty-three (623) foot
radius curve, concave Northerly with a long
chord of Two Hundred Eighty and Ninety-five
Hundredths (280 . 95) feet, bearing S 65°33' 33"
E to the North line of said railway; thence N
70°11' 26" E Three Hundred Ninety and Ninety-
nine Hundredths (390 . 99) feet along said
North line to a point which is Sixty (60)
feet normally distant West of the East line
of said Northeast Quarter (NEk) . Said point
also being on the West line of Elk Run Road;
thence S 76°03' 26" W One Hundred Twenty and
Eighty-one Hundredths (120 . 81) feet; thence
Westerly Four Hundred Seventy and Fifty-one
Hundredths (470 . 51) feet along a Five Hundred
Twenty-three (523) foot radius curve, concave
Northerly with a long chord of Four Hundred
Fifty-four and Eight Tenths (454 . 80) feet
bearing N 78°18' 43" W; thence N 52°32' 21" W
Four Hundred Eighty-two and Sixty-two
Hundredths (482 . 62) feet to the North line of
said NEk; thence N 89°41' 15" W along said
North line One Hundred Sixty-five and Six
Tenths (165 . 60) feet to the point of
beginning, except all legal highways, all in
the City of Waterloo, Black Hawk County,
Iowa.

Subject to all restrictive covenants and
easements of record and to the provisions of
the zoning ordinance .
WHEREAS, due to the insignificant nature of said minor site
plan amendment, the Council did not deem it necessary to hold a
public hearing, and
WHEREAS, it is the opinion of this Council that said minor
site plan amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the minor site plan amendment for
Warren Transport for property generally located at the southwest
corner of Newell Street and North Elk Run Road to build a 60' x
60' additional building just to the south of the existing
accessory building and a 70' x 150' office building, be and the
same is hereby approved.
PASSED AND ADOPTED this 13th day of December, 1999, and
approved by the Mayor this 15th d f December, 1999 .
