RESOLUTION NO. 2012-654
RESOLUTION APPROVING A DEVELOPMENT AGREEMENT
WITH RESIDENTIAL DEVELOPMENT PARTNERS, LLC TO
AUTHORIZE THE SALE AND CONVEYANCE OF A
PORTION OF CITY OWNED PROPERTY FOR $1.00
COMMONLY KNOWN AS THE FORMER VAN EATON SCHOOL
SITE, FORMER LAFAYETTE SCHOOL SITE, BALTIMORE
FIELD, AND WILLISTON FIELD, FOR THE INFILL
DEVELOPMENT OF HOUSING WITHIN THE CITY OF
WATERLOO.
WHEREAS, the Development Agreement dated June 25, 2012
between Residential Development Partners, LLC and the City of
Waterloo, Iowa, for the infill and new home development of the
former Van Eaton School site, former Lafayette school site,
Baltimore Field, and Williston Field, and
WHEREAS, the City shall convey property by quit claim deed
to the developer, and
WHEREAS, an offer to purchase said certain real property has
been made by Residential Development Partners, LLC for $1.00, as
described below, and
WHEREAS, a public hearing was held on June 25, 2012, at 5:30
p.m. in the Harold E. Getty Council Chambers, City Hall,
Waterloo, Iowa, as provided by law, by the Council of the City of
Waterloo, Iowa on the proposal to sell and convey premises owned
by the City of Waterloo, Iowa, to Residential Development
Partners, LLC, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1. The following described real property, as fully described
in the published notice in the Waterloo Courier on June 21, 2012,
is not presently needed and will not be needed in the foreseeable
future for municipal purposes and its ownership is serving no
municipal purpose, and
2. That the offer of Residential Development Partners, LLC,
to purchase real property for the sum of $1.00, be and it is
hereby accepted for real property described below:
Former Van Eaton School Site
A replat of the West of Cushman Heights, Lot 2, Block 2,
all in the City of Waterloo, Black Hawk County, Iowa.
Former Lafayette School Site
Lots 5 through 11 in Block 18 in Linden Place in Waterloo,
Black Hawk County, Iowa; known as the former Lafayette
School property, all in the City of Waterloo, Black Hawk
County, Iowa.
Baltimore Field
Lot No. 3 in Auditor Francis' Dry Run Plat in the City of
Waterloo, excepting the South 30 feet thereof heretofore
conveyed to the City of Waterloo, Iowa, for street purposes,
all in the City of Waterloo, Black Hawk County, Iowa.
Williston Field
Lot No. 5, except the East 156 feet thereof in Auditor
Resolution No. 2016-027

Francis' Reitzel Plat, and
Orlo C. Miller Addition, all of Lot 1, except the West 30
feet, Lot 2, and, all that part of Byron Avenue in the City
of Waterloo, Iowa, lying East of a Northerly extension of
the West line of Lot No. 1 in Orlo C. Miller Addition, and
West of a line that is 156 feet West of the West line of
Baltimore Street. Also, all that part of Denver Street in
the City of Waterloo, Iowa, lying South of the South line of
Byron Avenue and North of the North line of Eureka Street,
all in the City of Waterloo, Black Hawk County, Iowa.;
3. That the City of Waterloo, Iowa conveys said parcel of
real property to Residential Development Partners, LLC, by quit
claim deed.
4. That the Mayor and City Clerk are hereby authorized to
execute said quit claim deed to Residential Development Partners,
LLC.
5. That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the Community Planning and Development Department
is authorized and directed to deliver said quit claim deed of
conveyance to Residential Development Partners, LLC, upon receipt
in the sum of $1.00.
7. That the Mayor and City Clerk are hereby authorized to
execute said Development Agreement with Residential Development
Partners, LLC, on behalf of the City of Waterloo, Iowa.
