RESIDENTIAL REHABILITATION DEVELOPMENT AGREEMENT This Agreement is made this t day of A u q �,i ; 4— 2006 between M U 4" V1 c >Lci+ hereafter referred to as "Property Owner", and the City of Waterloo, Iowa, hereinafter referred to as "City", and agrees to the following: 1. That this Agreement concerns real property know as 219 Sumner Street, Waterloo, Black Hawk County, Iowa (See attached legal description). 2. The parties agree that the real estate located at 219 Sumner Street in its current state constitutes a dangerous and unsafe structure, and a nuisance under applicable laws or municipal codes. 3. That the City will not attempt to tear this property down so long as the Property Owner complies with the terms of this Agreement. Failure by the Property Owner to abide by the terms of this Agreement will result in the termination of this Agreement and the eventual tearing down of the property by the City pursuant to this Agreement or Consent to Demolish Form. 4. If the Property Owner agrees to execute Consent to Demolish Form prior to commencement of improvements, then in the event of a default of any or all terms and conditions of this Agreement, the Consent to Demolish becomes self-executing without further legal action or court proceeding. 5. That the following repairs must be made by the Property Owner in order to keep the City from tearing the structure down. The Property Owner has the opportunity to complete a pre-inspection with an inspector for the City of Waterloo, and the parties have agreed that these repairs are necessary and that the Code permits the Property Owner to conduct any carpentry repairs with proper permits. Any plumbing, electric and heating shall be repaired or replaced by a licensed contractor. The Property Owner must have these repairs completed on or before February 28, 2007. On that date, the Property Owner will allow the City to enter the premises and inspect. The following repairs shall be made by that date: a. Property Exterior i. Repair front porch ii. Reinstall fascia on house iii. Paint or install siding b. Property Interior i. Repair any broken windows ii. Repair any damaged ceilings, walls, or floor coverings iii. Repair Items discussed in VJ Engineering' s structural analysis (see attached) 6. In addition to the above repairs, the Property Owner will also make the following upgrades: a. Install new water heater and furnace to meet Mechanical Code b. Update gas service to meet Mechanical Code c. Update electrical to meet Electrical Code d. Update plumbing to meet Plumbing Code 7. Extensions. The City upon good cause shown by the Property Owner may grant extensions. The City may extend this Agreement, however, it is under no obligation to do so. 8. Inspections. The Property Owner hereby gives the City the right to enter upon this property at any time following the execution of this Agreement for purpose of inspecting what work has been done and what work remains to be done. Should the City discover additional code or safety violations in the process of future inspections, the City shall have the right to add these items to this Agreement. The Property Owner may request an extension at that time. 9. That this Agreement is binding upon both parties, their successor and assigns.
