ORDINANCE NO. 5620
AN ORDINANCE APPROVING A REQUEST BY THE CITY
OF WATERLOO TO VACATE 0.27 ACRES OF CITY OWNED
RIGHT-OF-WAY AT EAST HIGH SCHOOL AT 214 HIGH
STREET AND RETAINING A UTILITY EASEMENT OVER
THE ENTIRETY AND RESCINDING ORDINANCE NO. 4459.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
AS FOLLOWS:
Section 1. That the request by the City of Waterloo to vacate 0.27 acres of city owned
public right-of-way, located at East High School, 214 High Street, and legally described as follows:
THAT PORTION OF SOUTH BARCLAY STREET LYING NORTH OF VINE
STREET AND SOUTH OF THE ILLINOIS CENTRAL RAILROAD (NOW
CANADIAN NATIONAL RAILROAD) PROPERTY, SUBJECT TO THE
RETENTION OF AN EASEMENT FOR UTILITIES OVER ALL
shall be, and the same is hereby vacated, subject to the retention of an easement for public utilities
over, under, upon and across the vacated area.
Section 2. BE IT FURTHER RESOLVED that Ordinance No. 4459 be, and the
same is hereby rescinded in its entirety.
