Present are Attorney David R. Zellhoefer representing the Petitioner and Kelly Smith representing M. R. Reynolds, Mark Cambrick, the Heirs of David Sykes, Jr., and the Heirs of Roy Reynolds and Doris Reynolds. THE COURT notes that proof of service of all parties has been shown. The Petition and Original Notice were posted on the property on June 8, 2006. The Respondents, DLUS Bank, Iowa Department of Revenue and The Internal Revenue Services, were served by certified mail, return receipt requested, with proper service being returned. The remaining Respondents were served by publication by prior Order of this Court and were represented by Attorney and Guardian ad Litem Kelly Smith. THE COURT has reviewed the file and has found that proper Notice of Intent to Take Default against all served parties was mailed on September 21, 2006, and more than ten days have passed since that date. No party has filed an appearance and answer in this matter, andI the Court hereby finds all named Respondents to be in default herein. o 3 THE COURT makes the following findings of fact: N T to O � QUo 1. Presently, the property taxes on the property are delinquent. There are no utilities being provided to the property. The property is SLACK HAIEM�CV'COUMY ASSESSOR u unoccupied and has been vacant for a number of years. The property does not meet the city's housing code for being fit for human habitation or occupancy. The building is presently boarded up, but was exposed to the elements on prior dates, which made it deteriorate substantially. There is a large presence and accumulation of debris and uncut vegetation. 2. That because of the findings of fact made above, the Court determines that the property is an abandoned building pursuant to Section 657A.1OA. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED, that the property cited above is an abandoned property pursuant to Section 657A.1OA; judgment is hereby ordered in favor of the Petitioner, City of Waterloo, and the Court hereby awards title of this property to the City of Waterloo.
