HomeMy WebLinkAboutEarthTech - Supplemental Agreement #1 East Side Sanitary Sewer Interceptor - 12/12/2005 1103 EarthTech 501 Sycamore Street P 319.232.6531 Suite 222 F 319.232.0271 A tgCO International Ltd.Company Waterloo, IA 50703 earthtech.com SUPPLEMENTAL AGREEMENT NO. 1 EAST SIDE SANITARY SEWER INTERCEPTOR WATERLOO,IOWA WHEREAS,a Professional Services Agreement was entered into between the City of Waterloo,Iowa,(Client) and Earth Tech, Inc., of Waterloo, Iowa, dated September 6, 2005, for the investigation of alternative alignments for the East Side Interceptor Sanitary Sewer in Waterloo, Iowa; and WHEREAS,the Client and Earth Tech now desire to enter into Supplemental Agreement No. 1 for Phase II- Design Services and Phase III-Construction Phase Services for construction of sanitary sewer along the flood control dike between 6`"Street and 1 Oth Street. NOW THEREFORE,it is mutually agreed to amend the original Professional Services Agreement as follows: I. PROJECT DESCRIPTION The East Side Sanitary Sewer Interceptor-Segment 1 consists of construction of approximately 2,500 L.F.of 60-inch diameter pipe running generally along the flood control berm between 6"'Street and 10'' Street. The project will shift a portion of the city's east side sanitary sewer interceptor system from the river side of the flood control berm. The design of the project will evaluate the current 48-inch pipe and connection at 6a'Street to see if it can be used and/or rehabilitated for use to avoid construction of the new pipe in the vicinity of 6h Street and the railroad. II. SCOPE OF SERVICES The Scope of Services will include the work, services,materials,equipment,personnel and supplies necessary to provide design survey, final design, preparation of plans, specifications and contract documents in a format compatible with City of Waterloo standards,assistance with bidding,review of bids and recommendation of award, and construction-related services after contract award. The services are further defined as follows: Design Services 1. Assign a project manager who will coordinate project activities and will be the principal liaison between the Client, Consultant and regulatory agencies. 2. Attend meetings with representatives of the Client to review the design objectives at appropriate times. One of the initial objectives will be to locate the relief sewer to maximize the flows that may be redirected to the intercity interceptor. 3. Conduct field surveys to collect data to assist in the preparation of the plans. Property surveys are not included in this task. -1- 4. Collect information from the Client and utilities in the project area to assist in the preparation of the plans. Earth Tech may rely upon this information without independent verification in performing the Services. 5. Prepare plans using aerial photo base maps. 6. Assist the Client in compiling existing subsurface information. When,in the opinion of Earth Tech, additional soil borings or other subsurface explorations are necessary to secure information for design purposes,Earth Tech will assist the Client in selecting a geotechnical engineering consultant to perform the subsurface explorations and prepare a geotechnical report. 7. Prepare up to three easement and property descriptions for use by the Client in preparing easement and property acquisition documents. 8. Prepare construction bidding documents for receiving competitive bids. Such documents will be based on Client standards. 9. Prepare an estimate of probable construction costs for the proposed project. 10. Submit the bidding document to the Client for review and approval. 11. Meet with the Client to discuss the bidding documents and revise the bidding documents in response to expressed concerns by the Client. 12. Assist the Client in obtaining approval of the Iowa Department of Natural Resources and the U.S. Army Corps of Engineers by submitting documents to said agencies and responding to comments,if necessary. 13. Prepare up to 30 sets of contract documents for distribution to plan rooms, suppliers and potential bidders. 14. Assist the Client in advertising for and receiving bids,analyze the bids received and prepare a recommendation to the Client for award of contract. Construction-Related Services 1. Assist the Client in assembling the contract documents for execution by the Contractor and the Client. 2. Conduct a preconstruction conference with representatives of the Contractor, Client, Consultant and affected utilities and other interested parties. 3. Provide horizontal and vertical control for the project including: 3.1 Grade Stakes-Line, grade and manhole locations. -2- 3.2 Construction Limits - Identify where needed. Property staking or surveys are not included within the scope of this item. 4. Review shop drawings and other submittals as required of the Contractor by the contract documents for conformance with the design concept of the Project and compliance with the information given in the contract documents. 5. Answer design interpretation questions from the Client, Contractor, review staff and appropriate agencies. 6. Process monthly applications for payment submitted by the Contractor and forward to the Client for execution with recommendations for approval and payment. 7. Witness/provide,where applicable,field testing of the facilities furnished under the contract to assist in determining conformance with the contract documents. 8. Visit the construction site by design personnel at appropriate stages of construction to review the quality of the work and to determine, in general, whether the work conforms with the contract documents. 9. Assist the Client and Contractor in preparing and processing contract change orders. 10. Provide periodic field observation during construction to review the work of the Contractor to determine if the work is proceeding in general accordance with the contract documents and that completed work appears to conform to the contract documents. Anticipating the construction schedule to be approximately 90 days,periodic field observation staff shall consist of a field representative for approximately 360 hours of service. Staffing requirements may be adjusted during the project in relation to the level of construction activity. 11. Report to the Client any work believed to be unsatisfactory, faulty or defective or does not conform to the contract documents,and advise the Client of any work that should be corrected or rejected. 12. Consider and evaluate Contractor's suggestions for modifications and report them with recommendations to the Client. 13. Maintain files for correspondence,reports of the job conferences,shop drawings and sample submissions,reproductions of original contract documents including addenda,change orders, field modifications, additional drawings,issued subsequent to the execution of the contract, Engineer clarifications and interpretations of the contract documents, progress reports and other project-related documents. -3- 14. Keep a diary, log book or report for those times on site, recording hours on the job site; weather conditions;data relative to questions of extras or deductions;list of visiting officials and representatives of manufacturers, fabricators, suppliers and distributors; activities; decisions,observations in general and specific observations in more detail when necessary,as in the case of observing test procedures. 15. Conduct a review of the project near completion and prepare a list of items to be completed or corrected. 16. Perform a field observation of the completed project before a final application for payment is processed for the Contractor. 17. Provide the Client with a copy of revised drawings of the construction plans for the project based on the construction observation records of the review staff and Contractor showing those changes made during construction considered significant. 18. Assist the Client with the final close-out documentation from the Contractor. III. COMPENSATION AND PAYMENT Compensation for the above services shall be on an hourly basis in accordance with the hourly fees and other direct expenses at the time the services are performed. The estimated compensation of One Hundred Ten Thousand Dollars($110,000.00)shall not be exceeded without authorization from the Client. IV. In all other respects, the obligations of the Client and Earth Tech shall remain as specified in the Professional Services Agreement dated September 6,2005.
