COME NOW the parties, the City of Waterloo (hereinafter referred to as "City"), and
Richard Jones (hereinafter referred to as "Jones"), and agree to the following:
1. That this Agreement concerns real property known as 2554-2556 Edgemont,
Waterloo, Black Hawk County, Iowa, and legally described as:
Lot 8, Southaven Addition, Waterloo, Iowa.
2. The parties agree that the real estate located at 2554-2556 Edgemont is in
disrepair and does not, in many ways, meet the criteria of various municipal
Codes for the upkeep of residential property.
3. That there is presently in effect, a Court Order allowing the City of Waterloo to
tear this property down, in Case No. WT006628.
4. That the City will not tear this property down so long as Jones complies with the
terms of this Agreement. Failure by Jones to abide by the terms of this Agreement
will result in the termination of this Agreement and the eventual tearing down of
the property by the City pursuant to a lawful Court Order.
5. That the following repairs must be made by Jones in order to keep the City from
tearing the structure down. Jones has had an opportunity to meet with Louis
Cutwright, Jr., Building Official for the City of Waterloo, and the two have
agreed that these repairs are necessary and that Jones can complete these repairs.
Jones must have these repairs completely on or before March 1, 2006. On that
date, he will allow the City to enter the premises and inspect.
The following repairs shall be made by that date:
a. Property Exterior
i. Replace doors
ii. Repair damaged siding, walls, and dormer
iii. Level the porch slab—when weather pen-nits
iv. Completely paint the exterior—when weather permits
b. Property Interior at 2554 Edgemont
i. Repair broken windows
ii. Install new floor coverings in the living room, bedrooms, and kitchen
iii. Paint the interior
iv. Repair the ceilings
v. Make certain that all Safety Code issues are met for rental property,
including areas such as bandrails, smoke alarms, etc. This may require
inspection by the Waterloo Fire Department, which shall be the

responsibility of Jones to obtain. Jones shall be in complete
compliance with the Rental Property ordinances by March 1, 2006.
C. Property Interior at 2556 Edgemont
i. Install new floor coverings in the living room, bedrooms, and kitchen
ii. All ceilings will be repaired
iii. Interior will be painted
iv. Rental Safety Code issues will be met with areas such as handrails,
smoke alarms, etc. Again, the Waterloo Fire Department will inspect
when Jones is ready.
6. In addition to the above,Jones will also make the following upgrades:
a. Will make certain that water heaters in both units are up to Code
b. Will make certain that the furnaces and air conditioners in both units are
up to Code. In order to facilitate this, Jones will have a Code Enforcement
Officer from the City of Waterloo come to the residence to inspect water
heaters, furnaces, and air conditioners.
7. Extensions Upon Good Cause Shown by Jones. The City may extend this
Agreement, however, it is under no obligation to do so.
8. Inspections. Jones hereby gives the City the right to enter upon this property at
any time following the execution of this Agreement for purpose of inspecting
what work has been done and what work remains to be done. Should the City
discover additional code or safety violations in the process of future inspections,
the City shall have the right to add these items to this Agreement. Jones may
request an extension at that time.
9. That this Agreement is binding upon both parties, their successors and assigns.
This Agreement cannot be assigned without the written permission of the other
party.
10. Within one day of execution of this Agreement, the City will notify MidAmerican
Gas and Electric and grant them permission to install the electric service line from
the electric utility pole to the house meter. Holidays and weekends will not be
counted in this time period.

Eckert, to me personally known, and who, being by me duly sworn, did say that they are the
Mayor and City Clerk, respectively, of the City of Waterloo, Iowa; that the seal affixed to the
foregoing instrument is the corporate seal of the corporation, and that the instrument was
signed and sealed on behalf of the corporation by authority of its City Council as contained in
the Resolution adopted by the City Council, under Council Action No. La.2.7416) of
the City Council on the /,1'��' day of Deeen,Gel , 2005, and that Timothy J. Hurley
and Nancy Eckert acknowledged the execution of the instrument to be their voluntary act and
deed and the voluntary act and deed of the corporation, by it voluntarily executed.
