RESOLUTION APPROVING AN ACQUISITION CONTRACT
WITH BURK A. MIEHE AND JULIANNE D. MIEHE, TO
ACQUIRE 0.81 ACRES OF RIGHT-OF-WAY AND
APPROVING A TEMPORARY EASEMENT AGREEMENT
FOR 0.36 ACRES, IN THE AMOUNT OF $11,178.00, AND UP
TO $1,000.00 IN CLOSING COSTS, LOCATED NORTH OF
6216 HAMMOND AVENUE, IN CONJUNCTION WITH THE
HAMMOND AVENUE SINK CREEK BRIDGE
CONSTRUCTION PROJECT, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID
DOCUMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the acquisition contract, in conjunction with the Hammond Avenue Sink Creek Bridge
Construction Project, in the amount of $11,178.00 and up to $1,000.00 in closing costs between
Burk A. Miehe and Julianne D. Miehe and the City of Waterloo, Iowa, to acquire 0.81 acres of
right-of-way, and legally described as follows:
THAT PART OF TRACT "A", HAWKEYE HEIGHTS SUBDIVISION, WHICH
IS ALSO PART OF THE NORTHEAST QUARTER (NE 1/4) OF SECTION 22,
TOWNSHIP 88 NORTH, RANGE 13 WEST, OF THE FIFTH PRINCIPAL
MERIDIAN, WATERLOO, BLACK HAWK COUNTY, IOWA, DESCRIBED
AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF THE AFORESAID
NORTHEAST QUARTER; THENCE S00°09'37"E 614.28 FEET ALONG THE
EAST LINE OF SAID NORTHEAST QUARTER; THENCE S88°52'53"W
33.00 FEET TO THE NORTHEAST CORNER OF PARCEL "A", DOCUMENT
NO. 2017-15794 IN THE BLACK HAWK COUNTY RECORDER'S OFFICE;
AND TO THE POINT OF BEGINNING;THENCE S00°08'50"E 509.59 FEET
ALONG SAID EAST LINE OF SAID PARCEL "A" TO THE SOUTHEAST
CORNER OF AFORESAID TRACT "A"; THENCE S88°56'40"W 27.48 FEET
ALONG THE SOUTH LINE OF SAID TRACT "A"; THENCE N17°16'08"W
221.04 FEET; THENCE N05°13'52"E 168.96 FEET; THENCE N09°13'52"E
131.39 FEET TO NORTH LINE OF AFORESAID PARCEL "A"; THENCE
N88°52'53"E 55.31 FEET ALONG SAID NORTH LINE TO THE POINT OF
BEGINNING CONTAINING 0.81 ACRES.
is hereby approved, and the Temporary Construction Easement Agreement between Burk A.
Miehe and Julianne D. Miehe and the City of Waterloo, Iowa, to acquire 0.36 acres of right-of-
way and legally described as follows:

UNDER AND ACROSS THAT PART OF TRACT "A", HAWKEYE HEIGHTS
SUBDIVISION, WHICH IS ALSO PART OF THE NORTHEAST QUARTER
OF SECTION 22, TOWNSHIP 88 NORTH, RANGE THIRTEEN WEST OF
THE FIFTH PRINCIPAL MERIDIAN, WATERLOO, BLACK HAWK
COUNTY, IOWA, DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHEAST CORNER OF AFORESAID
NORTHEAST QUARTER; THENCE S00°09'37"E 614.28 FEET ALONG THE
EAST LINE OF SAID NORTHEAST QUARTER; THENCE S88°52'53"W 33

documents on behalf of the City of Waterloo, Iowa.
