HomeMy WebLinkAbout3486-06/15/1987 ORDINANCE NO. 3486 AN ORDINANCE AMENDING ORDINANCE NO. 2479 , AS AMENDED, KNOWN AS THE ZONING ORDINANCE, OF THE CITY OF WATERLOO, BY REPEALING: PART V, GENERAL REGULATIONS, SECTION 2A-7 , GENERAL REGULATIONS, SUBSECTION L, ZONING DISTRICT DIVIDING PROPERTY; AND ENACTING IN LIEU THEREOF A NEW: PART V, GENERAL REGULATIONS, SECTION 2A-7 , GENERAL REGULATIONS, SUBSECTION L, ZONING DISTRICT DIVIDING PROPERTY; AND BY REPEALING: PART XV, "M-1" LIGHT INDUSTRIAL DISTRICT, SECTION 2A-33 , REGULATIONS, SUBSECTION A, PRINCIPAL PERMITTED USES; AND ENACTING IN LIEU THEREOF A NEW: PART XV, "M-1" LIGHT INDUSTRIAL DISTRICT, SECTION 2A-33 , REGULATIONS, SUBSECTION A, PRINCIPAL PERMITTED USES; AND BY REPEALING: PART XV, "M-1" LIGHT INDUSTRIAL DISTRICT, SECTION 2A-35 , BULK REGULATIONS; AND ENACTING IN LIEU THEREOF A NEW: PART XV, "M-1" LIGHT INDUSTRIAL DISTRICT, SECTION 2A-35 , BULK REGULATIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: That Subsection L, Zoning District Dividing Property, of Section 2A-7 , General Regulations, of Part V, General Regulations , of the Zoning Ordinance, is hereby repealed in its entirety; that a new Subsection L, Zoning District Dividing Property, of Section 2A-7 , General Regulations, of Part V, General Regulations, of the Zoning Ordinance, is hereby enacted in lieu thereof as follows: L. Zoning District Dividing Property. When one ( 1 ) parcel of property is divided into two ( 2 ) or more portions by reason of different zoning district classifications, each portion shall be used independently of the other in its respective zoning classifications, and for the purpose of applying the regulations of this ordinance, each portion shall be considered as if in separate and different ownership. Alternatively, the entire parcel may be used as permitted by the regulations applicable to the most restrictive zoning classification. However, nothing in this sub-section shall be construed as permitting new residential use of any property within any light industrial district classification. That Subsection A. , 1 . Principal Permitted Uses , of Section 2A-33 , Regulations , of Part XV, "M-1" Light Industrial District, of the Zoning Ordinance, is hereby repealed in its entirety; that a new Subsection A. , 1 . Principal Permitted Uses, of Section 2A-33 , A. Regulations, of Part XV, "M-1" Light Industrial 0 N Ordinance No. 3486 Page 2 District, of the Zoning Ordinance, is hereby enacted in lieu thereof as follows: A. Principal Permitted Uses 1. Any use permitted in the "C-3" District, except that no occupancy permit shall be issued for any school, hospital, clinic, or other institution for human care, or new dwelling except where incidental to a permitted use. That Section 2A-35, Bulk Regulations, of Part XV, "M-1" Light Industrial District, of the Zoning Ordinance, is hereby repealed in its entirety; that a new Section 2A-35, Bulk Regulations, of the Zoning Ordinance, is hereby enacted in lieu thereof as follows: 2A-35 . Bulk Regulations. ( 1 ) The front yard depth of any lot abutting on a "Major Street" shall be measured from the proposed right-of-way line as shown on the Official Major Street Plan. ( 2 ) For every additional foot the front yard depth is increased over 25 feet, the rear yard may be decreased in direct proportion thereto, but in no case shall the rear yard be less than eight ( 8) feet; and in addition, if any portion of this rear yard area is used for an enclosed off-street loading space, the area above such an enclosure may be used for building purposes. This regulation shall not apply if the lot in question is adjacent to an "R" District. ;;oc 274AGE.783 Ordinance No. 3486 Page 3 ( 3 ) On parcels of land in this district which abut the flood control dikes established as part of the U.S. Army Corps of Engineers Flood Control Project, the minimum rear yard shall be sixteen ( 16 ) feet. ( 4 ) For every additional foot the front yard depth is increased over 25 feet, the rear yard may be decreased in direct proportion thereto, but in no case shall the rear yard be less than eight ( 8 ) feet; unless the rear yard adjoins a railroad siding, in which case a loading dock may abut the rear lot line. In addition, if any portion of this rear yard area is used for an enclosed off-street loading space, the area above such an enclosure may be used for building purposes. ( 5 ) When an area was developed or partially developed prior to the effective date of this ordinance, a front yard may be less than twenty ( 20 ) feet which would be the same as the nearest front yard depth that was legally established prior to this ordinance. This includes only buildings addressed and/or having their front yard setback facing the same street. It does not include corner lots whose front yard is located on an adjacent street and uses the other street frontage as a side yard setback. These regulations apply to all legally permitted uses. Nothing written above shall be construed to reduce any platted building setback lines which are greater than twenty ( 20 ) feet.
