ORDINANCE AMENDING ORDINANCE NO. 2479 , AS AMENDED, BY ADDING
SUBSECTION NO. 16 TO SECTION 2A-7-N, CONDITIONAL ZONING.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1 . That Section 2A-7-N, of Ordinance No. 2479 , as
amended, be further amended by adding after Subsection No. 15 , of
said Section, the following Subsection No. 16 (sixteen) .
"16 .
Unplatted Waterloo West NW SW exc S 792 ft. and exc E 80 ft.
and exc N 50 ft. and exc W 120 ft. Sec 28 T89 R13 all in the
City of Waterloo, Black Hawk County, Iowa,
now zoned on the Zoning Map of Waterloo, Iowa, as "R-3, R-P"
Planned Residence District, be and the same is hereby zoned as
"C-Z" , Conditional Zoning District as above described, based on
the following conditions:
1. The batch plant and associated materials will be removed
from the site by December, 31 , 1988.
2. Materials stored upon or produced from the site will
only be utilized for the Hackett Road Bypass Project.
3 . All materials and equipment shall set back a minimum of
100 ' from Huntington Road and 200 ' feet from the
easterly property line.
4. Dust control measures will be taken as necessary.
5 . Hauling of raw and finished materials to and from the
batch plant site shall utilize the Hackett Bypass
Project Corridor as noted on the site plan. A temporary
variance to this route may be granted for delivering
material to the project site only upon applicant
receiving written authorization from the City Engineer.
Said temporary variance shall be for no longer than
three ( 31 consecutive working days and/or a total of
seven (7 ) working days for the duration of the project.
Section 2. That the City Clerk be, and he is hereby directed
to file a certified copy of this Ordinance with the Recorder of
Black Hawk County, Iowa.
PASSED AND ADOPTED by the City Council on the llth day of
January, 1988 , approved by the Mayor on the 13th day of January,
1988.
