AN ORDINANCE VACATING A PORTION OF THE SOUTHERLY
RIGHT-OF-WAY OF EAST SAN MARNAN DRIVE AND THE EAST
RIGHT-OF-WAY OF HAMMOND AVENUE, IN THE CITY OF WATERLOO,
BLACK HAWK COUNTY, IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
A part of Lot 1, Southtown, Waterloo, Black Hawk County,
Iowa, described as follows:
Commencing at the NW corner of the NW 1/4 of Section
11-88-13 ; thence S. 00°00 ' 00" W. along the West line of said
NW 1/4 a distance of 475. 00 feet; thence N. 90°00 ' 00" E. a
distance of 55. 00 feet to the point of beginning; thence N.
00°05 ' 00" W. a distance of 135 . 36 feet to the Northerly line
of said Lot 1; thence S. 88°50 ' 30" E. along the Northerly
line of said Lot 1 a distance of 10 . 00 feet; thence S.
00°05 ' 00" E. a distance of 134. 02 feet; thence S. 05°02 ' 00"
E. a distance of 228. 60 feet to the Southerly line of said
Lot 1 ; thence S. 89°26 ' 30" W. along the Southerly line of

Beginning at a point on the Northerly line of said Lot 13
which is 27 . 10 feet Easterly of the NW corner of said Lot 13 ;

along the Northerly line of said Lot 4 a distance of 357 . 10
feet to the point of beginning; thence S. 89°26 ' 30" W.
parallel with the South line of said SW 1/4 a distance of
172 . 93 feet; thence N. 49°56 ' 30" E. a distance of 429 . 92 feet
to the Easterly R-O-W line of E. San Marnan Drive; thence S.
00°14 ' 00" E. along said Easterly R-O-W line a distance of
143 . 23 feet; thence S. 49°56 ' 30" W. along said Easterly R-O-W
line a distance of 204 .75 feet to the point of beginning.
The South line of the SW 1/4 of Section 2-88-13 is assumed to
bear S. 89°26 ' 30" W. ;
shall be, and the same is hereby vacated, with the City' s
retention of an easement over, under, and above the above
described parcels.
