AN ORDINANCE AMENDING THE WATERLOO ZONING ORDINANCE BY
REPEALING SUBSECTION ( 105 ) RUBBLE FILL SITE, OF SECTION
2A-3 , DEFINITIONS, PART III ; AND BY ENACTING IN LIEU
THEREOF SUBSECTIONS ( 105 ) RUBBLE FILL AND ( 105a) RUBBLE
DISPOSAL SITE OR RUBBLE FILL SITE, TO SECTION 2A-3 ,
DEFINITIONS, PART III ;
AND BY ADDING SUBSECTION 9 , RUBBLE DISPOSAL SITE OR
RUBBLE FILL SITE, TO SUBSECTION H, SPECIAL PERMIT
REQUIRED, OF SECTION 2A-48 , EXCEPTIONS AND
MODIFICATIONS, OF PART XXII .
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That Subsection ( 105) Rubble Fill Site, of Section 2A-3 ,
Definitions, Part III , of the Waterloo Zoning Ordinance, is hereby
repealed in its entirety; that new Subsections ( 105 ) Rubble Fill
and ( 105a) Rubble Disposal Site or Rubble Fill Site, of Section
2A-3 , Definitions, Part III , of the Waterloo Zoning Ordinance, are
hereby enacted in lieu thereof as follows :
( 105 ) Rubble Fill: Material or refuse such as dirt,
rock, clay, stone, brick or similar inorganic material.
( 105a) Rubble Disposal Site or Rubble Fill Site: The
premises where rubble fill is placed, set down or deposited for
the purpose of , or which has the result or effect of changing the
existing contour or raising the elevation of said land with 25
cubic yards or more of fill. A fill site is also where the
owner/operator advertises "fill wanted" regardless of the volume.
Temporary above-ground storage during construction and rubble fill
in conjunction with an approved development plan would not be
considered a rubble disposal site or rubble fill site.
That Subsection 9 , Rubble Disposal Site or Rubble Fill Site,
is hereby added to Subsection H, Special Permit Required, of
Section 2A-48, Exceptions and Modifications, Part XXII , of the
Waterloo Zoning Ordinance, as follows:
9 . Rubble Disposal Site or Rubble Fill Site. A duplicate
of the application submitted to the Black Hawk County Health
Department shall be submitted to the Planning, Programming and
Zoning Commission. The application shall contain the signature of
landowner, legal description of property, a plot plan showing area
to be filled with existing and proposed final elevations. The
application shall also include an estimate of the number of cubic
yards necessary and length of time estimated to complete filling.
