AN ORDINANCE AMENDING THE 1988 TRAFFIC CODE BY REPEALING
SUBSECTION ( 17) OF SECTION 273 , SECTION 296, 297 , 298 ,
299 , 320 , 322, 325 , 326 AND 329 , ALL REGARDING PARKING;
AND BY ENACTING IN LIEU THEREOF NEW SUBSECTION ( 17) OF
SECTION 273 , NEW SECTION 296 , 297 , 298 , 299 , 320 , 325 ,
326 AND 329 , ALL REGARDING PARKING; AND ALSO BY
REPEALING SECTION 333 AND 351, APPLICATION OF REVENUE;
AND ENACTING IN LIEU THEREOF A NEW SECTION 353 ,
APPLICATION OF REVENUE; AND BY ADDING NEW SECTIONS 272,
AUTHORIZED ENFORCEMENT AGENCIES, SECTION 311, FEES -
MONTHLY AND RESERVED RAMP AND LOT PARKING, AND SECTION
334 , ONE VEHICLE PER SPACE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That Subsection ( 17 ) of Section 273 , and Section 296 , 297 ,
298 , 299, 320 , 322, 325, 326 and 329 , all related to parking, of
the 1988 Traffic Code are hereby repealed in their entirety; that
new Subsection ( 17) of Section 273 , and Section 296, 297 , 298 ,
299, 320 , 325, 326 and 329 , all related to parking, of the 1988
Traffic Code are hereby enacted in lieu thereof as follows:
SEC. 273 . No person shall stop, stand, or park a vehicle except
when necessary to avoid conflict with other traffic or in
compliance with the directions of a police officer or
traffic-control devices, in any of the following places:
17 . On any street or in any city owned parking lot or ramp
in the City of Waterloo for a continuous period of more than 48
hours, except for monthly parking as provided in Section 311 and
344. The violation of this subsection shall constitute said
vehicle a nuisance to be abated as provided by law, or members of
the police department may impound such vehicle as hereinafter
provided. For the purpose of the regulations herein provided, any
vehicle not moved out of the block during the specified and
designated parking periods, shall be deemed to have remained
stationary. The Motor Vehicle Parking Facilities personnel are
hereby authorized to have such vehicle towed.
SEC. 296. 30 MINUTE PARKING.
When signs are erected in each block or portion thereof
affected, giving notice, no person shall park a vehicle for longer
than 30 minutes at any time in any parking space upon any of the
streets or portions thereof designated in Section 558 of this
ordinance. Each successive 30-minute interval is a new violation.
SEC. 297. 30 MINUTE PARKING.
When signs are erected in each block or portion thereof
affected, giving notice, no person shall park a vehicle for longer
than 30 minutes at any time between the hours of 8 : 00 a.m. and
12 : 00 noon, except Saturdays and Sundays, in any parking space
upon any of the streets or portions thereof designated in Section
559 of this ordinance. Each successive 30-minute interval is a
new violation.
SEC. 298 . ONE-HOUR PARKING.
When signs are erected in each block, or portion thereof,
giving notice, no person shall park a vehicle for longer than one
hour at any time between the hours of 8: 00 a.m. and 6 : 00 p.m. in

any parking space upon any of the streets or portions thereof
designated in Section 560 of this ordinance. Each successive
one-hour interval is a new violation.
SEC. 299. TWO-HOUR PARKING.
When signs are erected in each block, or portion thereof,
giving notice, no person shall park a vehicle for longer than two
hours at any time within the hours designated in any parking space
upon any of the streets or portions thereof designated in Section
561 , 562 and 562A of this ordinance. Each successive two-hour
interval is a new violation.
PARKING METERS
SEC. 320 . DESIGNATION OF TWELVE MINUTES, THIRTY MINUTES, ONE
HOUR, TWO HOUR, FOUR HOUR AND TEN HOUR PARKING METER
AREAS.
The Department of Motor Vehicle Parking Facilities is hereby
authorized and directed to designate and mark off metered
individual parking spaces on streets and within designated parking
lots as conditions permit and shall install meters providing
parking time limits within the downtown area bound by Walnut
Street, Seventh Street, South Street and Westfield Avenue. The
location of the metered individual parking spaces and the type of
meters installed providing parking time limits shall be
designated by Resolution of the City Council.
SEC. 325 . It shall be unlawful and a violation of the provision
of this Article for any person to permit a vehicle to remain in
any parking place adjacent to any parking meter while said meter
is displaying a signal indicating that the vehicle occupying such
parking space has already been parked beyond the period of time
prescribed for such parking space.
Even though money has been put into the meter, parking for a
period of time over the time allowed on the meter will be a
violation. Each successive interval is a new violation.
SEC. 326. It shall be unlawful and a violation of the provisions
of this Article for any person to cause, allow, permit, or suffer
any vehicle registered in the name of or operated by such person
to be parked in an individual parking space reserved for another
as provided in Section 311.
SEC. 329. It shall be the duty of all personnel authorized to
enforce parking regulations to report:
(a) The number of each parking meter which indicates that
the vehicle occupying the parking space adjacent to such parking
meter is or has been parking in violation of either Section 324,
325, 326 or 328 ;
(b) The state license number of such vehicle;
(c) The time during which such vehicle is parking in
violation of either Section 324, 325 , 326 or 328 ;
(d) Any other facts, a knowledge of which is necessary to a
thorough understanding of the circumstances attending such
violation; the authorized personnel shall also attach to such
vehicle a notice to the owner or operator thereof that such
vehicle has been parking in violation of either Section 324 , 325 ,
326 or 328 and instructing such owner or operator to report at the
office of the Motor Vehicle Parking Facility of the City of
Waterloo, Iowa, in regard to such violation.

Each such owner or operator may, within twenty-four ( 24 )
hours after the time when such notice was attached to such
vehicle, deposit the sum of two dollars ( $2 . 00 ) in a meter fine
collection box provided for such purpose, and installed at various
locations within the City of Waterloo, or at the office of the
Motor Vehicle Parking Facility of the City of Waterloo, Iowa, as a
penalty for and in full satisfaction of a violation of Section
325 . If such owner or operator shall fail to pay the aforesaid
penalty of two dollars ( $2 . 00 ) in the manner herein provided, then
such owner or operator shall pay the office of the Motor Vehicle
Parking Facility of the City of Waterloo, Iowa, as a penalty for
and in full satisfaction of a violation of Section 325 , the sum of
five dollars ( $5 . 00 ) .
Each such owner or operator shall deposit the sum of five
dollars ( $5 . 00 ) in a meter fine collection box provided for such
purpose, and installed at various locations within the City of
Waterloo, or at the office of the Motor Vehicle Parking Facility
of the City of Waterloo, Iowa, as a penalty for and in full
satisfaction of a violation of Section 324 , 326 or 328.
That Section 333 and 351 , Application of Revenue, of the 1988
Traffic Code are hereby repealed in their entirety; that a new
Section 353 , Application of Revenue, of the 1988 Traffic Code is
hereby enacted in lieu thereof as follows:
SEC. 353 . APPLICATION OF REVENUE.
The money received for parking from parking ramp fees , coins
required to be deposited in parking meters , and fines collected
prior to a ticket being sent to District Court, as herein provided
are hereby levied and assessed as fees to be used for the
following purposes:
(a) Payment of the cost of acquisition and installation of
the meters purchased.
(b) Payment of the cost of maintenance and repair of meters,
the collection of meter taxes, and the enforcement of traffic laws
in the parking meter district.
(c) Payment of the purchase and installation costs of other
parking or traffic control devices installed on such portions of
streets as are equipped with parking meters.
(d) Payment of the cost of acquiring by purchase, lease, or
similar arrangement of parking lots, ramps , or other off-street
parking areas, including operation, enlargement or improvement
thereof, or the facilities thereof, within the meter district.
That Section 272 , Authorized Enforcement Agencies, Section
311 , Fees - Monthly and Reserved Ramp and Lot Parking, and Section
334 , One Vehicle Per Space, are hereby added to the 1988 Traffic
Code as follows:
SEC. 272 . AUTHORIZED ENFORCEMENT AGENCIES.
The Motor Vehicle Parking Facility of the Public Works
Division, the Waterloo Police Department and any other persons
authorized by Resolution of the City Council are hereby authorized
as the enforcement agencies for all parking regulations .

SEC. 311. FEES - MONTHLY AND RESERVED RAMP AND LOT PARKING.
Parking spaces in either parking ramps or parking lots may be
used for monthly parking upon payment of the required fee, IN
ADVANCE. Upon payment of the required fee a parking sticker shall
be issued, and displayed in a prominent location in the window of
the vehicle. RAMP PARKERS WILL RECEIVE A PASS CARD THAT WILL
REQUIRE A DEPOSIT. The monthly fees for parking spaces are
established as follows:
(a) Beginning January 1, 1989 , and continuing through June
30, 1990 , the fee for reserved, assigned stall parking shall be as
follows:
(1) East 5th Street Ramp $20. 00
(2) West 5th Street Ramp $25. 00
( 3 ) ConWay Ramp $30. 00
(4) East Park Avenue Ramp $30. 00
( 5) Parking Lots $15 . 00
(b) Beginning July 1, 1990 , and thereafter, the fee for
reserved, assigned stall parking shall be as follows:
(1) East 5th Street Ramp $25 .00
( 2) West 5th Street Ramp $30 . 00
( 3 ) ConWay Ramp $35 . 00
(4) East Park Avenue Ramp $35 . 00
(5 ) Parking Lots $20. 00
(c) Beginning January 1, 1989, and continuing through June
30, 1990 , the fee for unreserved parking shall be as follows:
(1) East 5th Street Ramp $15. 00
( 2 ) West 5th Street Ramp $20. 00
( 3 ) ConWay Ramp $25. 00
(4 ) East Park Avenue Ramp $25. 00
(d) Beginning July 1, 1990, and thereafter, the fee for
unreserved parking shall be as follows:
( 1) East 5th Street Ramp $20. 00
( 2) West 5th Street Ramp $25 . 00
( 3 ) ConWay Ramp $25 . 00
( 4) East Park Avenue Ramp $25. 00
SEC. 334. ONE VEHICLE PER SPACE.
When more than one vehicle is parked in a single parking
space in violation of the time period on the meter, each vehicle
so parked shall be presumed to be in violation.
