AN ORDINANCE DECLARING A MORATORIUM ALONG THE
INTERSTATE SUBSTITUTION CORRIDORS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
1. The City of Waterloo is, and has been, in the process of
the planning and construction of certain roadways within the
corporate city limits of the City of Waterloo, which roadways are
commonly known as the Interstate Substitution Program Corridors,
which are funded, in part, by Federal Interstate Substitution
monies.
2. The Corridor commonly known as U.S. 218 is one of the
major interstate corridors along which there is a potential for
the development of various businesses, which highway has made a
substantial impact upon the City of Waterloo.
3 . The City of Waterloo, by and through the statutes of the
State of Iowa, is vested with the responsibility of developing
long-range plans regarding the development of the City of
Waterloo.
4. The City Council of the City of Waterloo deems it to be
in the best interests of all of the citizens that a corridor
development plan should be developed in order to provide
comprehensive, reasonable regulations for development along the
U.S. 218 Interstate Substitution Corridor.
5. The City Council of the City of Waterloo believes that a
moratorium should be declared for development along U.S. 218 , for
a reasonable period of time, until said corridor development plan
has been presented to, and adopted by, the City Council of the
City of Waterloo.
BE IT FURTHER ORDAINED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that:
1. A moratorium is hereby declared on any and all
development, including but not limited to, signage, billboards,
architecture and landscaping, along and within three hundred ( 300)
feet of either side of the right-of-way of U.S. 218 and related
improvements thereto, which improvements are associated with the
U.S. 218 Project for six ( 6 ) months from the date of the enactment
of this Ordinance, which period may be extended for only one
increment of three ( 3 ) months upon a request made to the City
Council by the Planning, Programming and Zoning Commission, and
accomplished by affirmative action, in the form of a Resolution of
the Council.
2 . That a study should be prepared under the direction of
the Planning, Programming and Zoning Commission, which study shall
be made for the purpose of the enactment of a corridor development
plan, which plan shall be presented to the Council, for adoption,
prior to the expiration of this moratorium.
3 . That should undue hardship result from the enactment of
this moratorium, the affected person shall have the right to
appeal to the City Council, which appeal shall be treated as a
request for a change in zoning.
