AN ORDINANCE AMENDING THE 1988 TRAFFIC CODE BY REPEALING
SUBSECTIONS (a) AND (c) OF SECTION 309, PROHIBITED
PARKING DURING SNOW REMOVAL; AND BY ENACTING IN LIEU
THEREOF NEW SUBSECTIONS (a) AND (c) OF SECTION 309 ,
PROHIBITED PARKING DURING SNOW REMOVAL.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows:
That Subsections (a) and (c) of Section 309, Prohibited
Parking During Snow Removal, of the 1988 Traffic Code, are hereby
repealed in their entirety; that new Subsections (a) and (c) of
Section 309, Prohibited Parking During Snow Removal, of the 1988
Traffic Code, are hereby enacted in lieu thereof as follows:
SEC. 309. PROHIBITED PARKING DURING SNOW REMOVAL.
(a) Whenever the Mayor, Director of Public Works, or the
Director' s designee finds on the basis of falling snow, sleet,
freezing rain or the forecast of accumulations of snow or ice,
that weather conditions have created or are likely to create
hazardous road and driving conditions which will impede or are
likely to impede movement of fire, health, police, emergency or
other vital vehicular traffic, the Mayor, Director of Public Works
or the Director' s designee may declare that Snow Removal on
Priority One streets shall begin and prohibit parking or stopping
of vehicles on designated Snow Removal Routes. While the Snow
Removal is in effect, no person shall park, abandon or leave
unattended any vehicle upon any Priority One Snow Removal Route or
portion of such Route, as designated as such by Resolution of the
City Council. Each street designated as a Priority One Snow
Removal Route by the City Council, shall be marked with signs
displaying the words "No Parking During Snow Removal" .
A Snow Removal parking ban shall continue from its
proclamation through the duration of the snow or ice storm and
until the proper authority issues notice that the Snow Removal on
Priority One streets is at an end. The public will be notified
via local radio, television and newspaper when Snow Removal begins
and is concluded. The parking prohibition on Snow Removal Routes
shall not go into effect until two hours after a Snow Removal
operations have been declared in accordance with this Chapter.
Termination of the parking prohibition shall be effective
immediately upon the announcement that the Snow Removal on
Priority One streets is at an end.
(c) Any police officer of the Waterloo Police Department,
the Director of Public Works or the Director ' s designee shall be
authorized to cause the towing of vehicles blocking traffic or
parking on designated Snow Removal Routes during Snow Removal
operations in violation of this Section. The owner of the vehicle
shall pay the costs of towing and storage occasioned by the
removal of the vehicle as provided herein.
In addition to any police officer of the Waterloo Police
Department, the Director of Public Works, the Superintendent of
Streets, and the Street Department Foreman shall be authorized to
issue parking tickets for violations of Section 309, parking on
designated Snow Removal Routes during Snow Removal operations.
