HomeMy WebLinkAbout3616-01.23.1989 ORDINANCE NO. 3616 AN ORDINANCE AMENDING THE 1988 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY: REPEALING SUBSECTION 3-1/2-11(b) AND SUBSECTION 3-1/2-13 (a) , REGARDING LICENSE FEES, AND SUBSECTION 3-1/2-27(a) , FALSE ALARMS, OF CHAPTER 3-1/2, ALARM SYSTEMS; AND BY ENACTING IN LIEU THEREOF A NEW SUBSECTION 3-1/2-11 (b) AND SUBSECTION 3-1/2-13 (a) , REGARDING LICENSE FEES, AND SUBSECTION 3-1/2-27 (a) , FALSE ALARMS, TO CHAPTER 3-1/2, ALARM SYSTEMS; AND BY ADDING SUBSECTIONS 3-1/2-15 THROUGH 3-1/2-18, ALL DEALING WITH ALARM USERS, TO CHAPTER 3-1/2 , ALARM SYSTEMS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: That Subsection 3-1/2-11(b) and Subsection 3-1/2-13 (a) , regarding license fees, and Subsection 3-1/2-27(a) , False Alarms, of Chapter 3-1/2 , Alarm Systems, of the 1988 Code of Ordinances of the City of Waterloo, Iowa, are hereby repealed in their entirety; that a new Subsection 3-1/2-11(b) and Subsection 3-1/2-13 (a) , regarding license fees, and Subsection 3-1/2-27(a) , False Alarms, of Chapter 3-1/2 , Alarm Systems, of the 1988 Code of Ordinances of the City of Waterloo, Iowa, are hereby enacted in lieu thereof as follows: Sec. 3-1/2-11 . Application for license by alarm business. (b) License applications shall be accompanied by a non-refundable fee of Fifty Dollars ( $50. 00) to cover the costs of the city of processing the application and investigating the applicant. Prior to obtaining a license, every applicant shall file in the office of the City Clerk an indemnity bond with a corporate surety authorized to do business in this state or an insurance policy issued by a company authorized to do business in this state. The minimum limits of liability of said bond or insurance shall be as provided by resolution of the City Council, and said bond or insurance policy shall be issued for a period to cover the life of the license applied for. Failure to maintain such bond or insurance in full force and effect shall be grounds for revocation of the license. Sec. 3-1/2-13 . Fees and renewal. (a) On or before July 1 of each year, each alarm business having a license to do business in the City of Waterloo shall make application to renew its license by filing an application for renewal on an appropriate form provided by the City. The application for renewal shall list any changes in the information contained on its application for a license or since its last renewal. The application for renewal shall be accompanied by a fee of Fifty Dollars ( $50 . 00 ) . Sec. 3-1/2-27 . False alarms. (a) Effective February 1 , 1989 , an alarm user will be charged for each false alarm a fee pursuant to the following false alarm charge schedule: BOOK 284 PAGE t15 Ordinance No. 3616 Page 2 False Alarm Fee Schedule Beginning Each Fiscal Year First through and including fifth $ 30.00 Sixth through and including ninth $ 60. 00 Tenth through and including fifteenth $100 . 00 Sixteenth Disconnection of alarm Alarm users will only be charged for careless use of the alarms and not for malfunctions due to telephone company repairs or the alarm equipment itself. New alarm users shall be granted two ( 2 ) careless use alarms, without a fee schedule charge, during the first fiscal year of use. All careless use alarms after the two ( 2) nonchargeable alarms shall be subject to the false alarm fee schedule. Further, if an alarm user refuses to respond to the place of business or residence to reset the alarm after officers have responded to that location, the alarm call will be handled as a careless use alarm and the appropriate fee charged. That Subsections 3-1/2-15 through 3-1/2-18 , all dealing with alarm users, are hereby added to Chapter 3-1/2, Alarm Systems, of the 1988 Code of Ordinances of the City of Waterloo, Iowa, as follows: Sec. 3-1/2-15. Alarm User Fee. (a) Each licensed alarm business shall pay a fee for each alarm user in the City, to whom alarm systems have been leased, installed, or who are currently under contract with the licensed alarm business for services on or after July 1, 1989 . The fees shall be as follows: ( 1) Varitech system alarm user fee shall be Twenty Dollars ( $20 . 00 ) per year per alarm user. ( 2) Central station alarm user fee shall be Ten Dollars ( $10 . 00) per year per alarm user. (b) The alarm user fees shall be paid in each succeeding year by July 1st. (c) The alarm company shall be responsible for the entire annual fee whenever any new alarm system is installed. Sec. 3-1/2-16. Contact list. Each alarm user shall furnish to the City Clerk/Auditor, on or before July 1 of each year, an updated and accurate list of persons, including phone numbers, to contact when necessary in the event of an alarm signal at their business/residence at a time when it it unoccupied or unattended. Changes in said list after it is submitted shall be communicated to the Police Department without delay. Sec. 3-1/2-17 . Applicability. Sections 3-1/2-15 and 3-1/2-16 shall be applicable to all alarm users in the City of Waterloo, including, but not limited to: automatic holdup alarm system users, burglar alarm system users, central station system users, holdup alarm system users, manual holdup alarm system users and proprietary system users when such system signals the Police Department. If an alarm user employs a local alarm system, such system shall not be subject to the alarm user fee. However, the local alarm user shall comply with all other sections of this chapter. BOa 284 ?ACE 457 Ordinance No. 3616 Page 3 Sec. 3-1/2-18 . Failure to pay alarm user fee. If an alarm company fails to pay the alarm user fees by the due date each year, the Police Chief may issue written notice by certified mail of the intention of the Police Department to disconnect the alarm system from its connection to the Police Department or of the intention of the Police Chief to refuse to authorize response by Police Department personnel to future alarms from that alarm company' s alarm system. The alarm company may appeal the decision by the Police Chief as provided for in Section 3-1/2-27(c) through (g) .
