RESOLUTION NO. 2021-175
RESOLUTION APPROVING A PERMANENT EASEMENT
AGREEMENT FOR A 280 SQUARE FOOT DRAINAGE
EASEMENT FROM NORTH STAR COMMUNITY SERVICES,
INC., IN THE AMOUNT OF $319.20, LOCATED AT 3420
UNIVERSITY AVENUE, AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS, the Permanent Easement Agreement dated March 15, 2021, for the
following described parcel, is to allow for drainage improvements near the Ascension Lutheran
Church property located at 3420 University Avenue, and owned by North Star Community
Services, Inc.
WHEREAS, the City of Waterloo, Iowa, agrees to pay North Star Community Services,
Inc., $319.20 for a permanent 280 square foot drainage easement, located at 3420 University
Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Permanent Easement Agreement between North Star Community
Services, Inc. and the City of Waterloo, Iowa, in the amount of$319.20, for property located at
3420 University Avenue, to allow for drainage improvements near the Ascension Luthern
Church property, for the property legally described below, is accepted and approved.
THAT PART OF TRACT "A" PER PLAT OF SURVEY DATED 08/24/1984
AND RECORDED IN MISC. BOOK 257 PAGE 787 IN THE OFFICE OF THE
BLACK HAWK COUNTY RECORDER, ALL LYING IN THE SOUTHWEST
QUARTER (SW 1/4) OF SECTION NO. 21, TOWNSHIP NO. 89 NORTH,
RANGE NO. 13 WEST OF THE FIFTH PRINCIPAL MERIDIAN, WATERLOO,
BLACK COUNTY IOWA, DESCRIBED AS FOLLOWS:
THE NORTH 7.0 FEET OF THE WEST 40.0 FEET OF SAID TRACT "A".
CONTAINING 280 SQ. FT.
NOTE: THE WEST LINE OF SAID MISC. BOOK 257 PAGE 787 IS ASSUMED TO
BEAR NORTH 00°381/4'WEST FOR THIS DESCRIPTION
