Project Professional Service Agreement
between the City of Waterloo, Iowa and
Wayne Claassen Engineering and Surveying, Inc.
PROJECT: Hammond Avenue Bridge Replacement Project

You are hereby ordered to make the following changes to the existing Agreement for
Professional Services for the Hammond Avenue Bridge Replacement project, dated
10/02/2017
1. Add the following to said existing Agreement:
Part III. TERMS AND CONDITIONS
Article 1. ENGINEERING SERVICES
-1.1 Basic Services - The Engineer agrees to perform professional services in connection
with the Project, as set forth below and contained within this Agreement:
A. Preliminary Engineering Phase
Task 14. 'Additional HEC-RAS modeling and Report. Determine if adding sag vertical
curves to the new road profile will meet zero rise requirements. The hydraulic modeling
portion of this task will be completed by HR Green (HRG) as a subconsultant to CES. A
more detailed description of these services is attached herewith as HRG's Amendment
No. 2.
Task 15. CLOMR/LOMR Application Packets. Preparation of a Pre -Construction
Conditional Letter of Map Revision (CLOMR) packet and a Post Construction Letter of
Map Revision (LOMR) packet to FEMA, upon completion project construction. This
task will be completed by HR Green (HRG) as a subconsultant to CES. A more detailed
description of these services is attached herewith as HRG's Amendment No. 3.
Task 16. Surveying and Engineering to develop alternates for the location of the
Hawkeye Community College field access to their land South of Sink Creek.

2. Settlement for cost of work to be made as follows:
Task 14. This task increases the Basic Services Amount by $8,000, and includes
$3.600 completed by HR Green.
Task 15. This task increases the Basic Services Amount by $40,000, and includes
$35,800 completed by HR Green.
Task 16. This task increases the Basic Services Amount by $9,000.00.
The Professional Services Agreement is increased by $57,000 by this
Supplemental Agreement 5 to a total of $202,550.
3. All other sections of said existing Agreement remain unchanged.

PROFESSIONAL SERVICES AGREEMENT AMENDMENT NO. 2
THIS AMENDMENT, made this 1st day of September, 2021 by and between, Wayne Claassen
Engineering & Surveying, Inc. the CLIENT, and HR GREEN, INC. (hereafter "COMPANY"), for
professional services concerning:
Hammond Avenue Bridge Over Sink Creek:
Hydraulic Analysis
hereby amends the original Professional Services Agreement dated 4/18/2019 as follows:
The CLIENT and COMPANY agree to amend the Scope of Services of the original Professional
Services Agreement and previous amendments as follows:
• Setup, run and validate an additional HEC-RAS model scenario for a redesigned .3 box
culvert, whereby the centerline of Hammond Avenue is lowered by virtue of the top slab
becoming the road surface itself.
o The intent of this additional model run would be to
® Obtain a FEMA no -rise certification condition, if possible.
■ . If a no -rise isn't possible, the COMPANY would aim to obtain as small a
floodplain footprint as possible for a CLOMR/LOMR application that would
need to follow.
o One (1 hour) meeting with the CLIENT to present the findings of this additional
modeling is included.
• This amendment only covers the additional HEC-RAS modelling and does not cover the
following: items,which would be included in additional amendment(s) to follow:
-o- ._._The structural redesign of the top slab of the 3-box culvert.
o Preparation and submittal of a CLOMR/LOMR application packet.
_ :_ o -. Additional scenario planning for the project, if necessary.

The. CLIENT and COMPANY agree to amend other provisions of the original Professional Services
Agreement and previous amendments as follows:
Allowance of 10 working days to complete the modelling work, after this amendment is
executed.
In consideration for these services, the CLIENT AGREES to adjust the payment for services performed
by COMPANY on the following basis:
Per current rate schedule with a maximum fee to be increased by Three Thousand Six Hundred
Dollars ($3,600.00)
The total authorized compensation after this Amendment, including the original Professional Services
Agreement and all previous Amendments, is Fifty -Six Thousand Two Hundred Dollars ($56,200).
THIS AMENDMENT is subject to all provisions of the original Professional Services Agreement.

Engineering & Surveying, Inc. the CLIENT, and HR GREEN, INC. (hereafter "COMPANY"), for
professional services concerning:

The CLIENT and COMPANY agree to amend the Scope of Services of the original Professional
Services Agreement and previous amendments as follows:
CLOMR/LOMR Application Packets
1. Project Management as necessary to complete the tasks below.
2. Three (3) meetings with the client are included (assumed virtual)
3. One (1) pre -application meeting with Iowa DNR staff (assumed virtual)
4. Repackaging of floodplain mapping from the previously generated H&H model to create a
preliminary flood map panel to FEMA standards.
5. Pre -Construction Conditional Letter of Map Revision (CLOMR) Application: Preparation and
online submittal of an MT-2 application packet to FEMA, including completion of the MT-2
application form and supporting documentation. Two (2) response packets to FEMA/DNR
are anticipated.
Post -Construction Letter of Map Revision (LOMR) Application: Preparation and online
submittal of an MT-2 application packet to FEMA, including completion of the MT-2
application form and supporting documentation. Two (2) response packets to FEMA/DNR
are anticipated.
The CLIENT and COMPANYagreeto amend other provisions of the original Professional Services
Agreement and previous amendments as follows:
Deliverables:
1. Pre -Construction Conditional Letter of Map Revision (CLOMR) Application Packet submitted
to FEMA, 12 weeks after Notice to Proceed.
2. Post -Construction Letter of Map Revision (LOMR) Application Packet submitted to FEMA, 6
weeks after receipt of certified as -built survey of improvements from CLIENT.
3. The 1st and 2nd response to DNR's and/or FEMA's review comments will be provided within
4 weeks from receipt of each set of comments. If DNR and FEMA provide comments at
different times, COMPANY will respond in a timely manner to each set of comments — i.e. 2
agencies, 2 rounds of comments could result in up to 4 distinct responses from the
COMPANY.
Items not Included
The following items are not included as part of this AGREEMENT:
1. Site visits by COMPANY staff.

2. Surveying
3. Floodway no -rise certification
4. Locating storm sewer system structures and outfalls
5. Evaluation of proposed condition alternatives
6. Additional modelling work not outlined in the scope of services
7. Additional responses, over and above the response to the first 2 rounds of DNR and FEMA
reviews of the application packet. If additional responses are necessary for CLOMR/LOMR
approval, the COMPANYs required time on these will be evaluated in detail and the
AGREEMENT amended to right -size the effort.
8. Wetland Delineation(s).
9. The fee payable to FEMA that should accompany the submittal of the CLOMR and LOMR
application packets. These fees are published by FEMA here: https://www.fema.gov/flood-
maps/change-your-flood-zone/status/flood-map-related-fees. These are assumed to be paid
by the CLIENT.
10. Notification of adjacent property owners affected by rise of FEMA 100-year Base Flood
Elevation (BFE).
11.. Additional planning or design of any improvements associated with the CLOMR/LOMR.
In consideration for these services, the CLIENT AGREES to adjust the payment for services performed
by COMPANY on the following basis:
Per current rate schedule with a maximum fee to be increased by Thirty -Five Thousand, Eight
Hundred Dollars ($35,800.00)
The total authorized compensation after this Amendment, including the original Professional `Services
Agreementandall previous Amendments, is outlined in the table below:
