HomeMy WebLinkAbout3610-01/03/1989 ORDINANCE NO. 3610 AN ORDINANCE AMENDING THE 1988 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY REPEALING ARTICLE II , PLAYGROUNDS, OF CHAPTER 28 , PARKS AND RECREATION; AND BY ENACTING IN LIEU THEREOF A NEW ARTICLE II , RECREATION, OF CHAPTER 28, PARKS AND RECREATION. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: That Article II , Playgrounds , of Chapter 28 , Parks and Recreation, of the Code of Ordinances of the City of Waterloo, Iowa, is hereby repealed in its entirety; that a new Article II , Recreation, of Chapter 28, Parks and Recreation, of the Code of Ordinances of the City of Waterloo, Iowa, is hereby enacted in lieu thereof as follows: ARTICLE II . RECREATION. Division 1 . Generally. Sec. 28-12. Board of Recreation and Arts Commissioners Re-established. There shall be re-established a Board of Recreation and Arts Commissioners, responsible to provide recreational opportunities, in its broadest sense, to enhance the quality of life through active and/or passive pursuits by citizens of Waterloo, Iowa. Sec. 28-13 through 28-17 . Reserved. Division 2. Board of Recreation and Arts Commissioners. Sec. 28-18 . Composition; appointment, initial and regular terms of members; organization. (a) The board of recreation and arts commissioners shall consist of ten ( 10) members to be appointed by the Mayor with the approval of the Council. Three of the member ' s terms shall expire October 1, 1988 ; three of the member' s terms shall expire October 1, 1989 ; three of the member' s terms shall expire October 1 , 1990 . The tenth member of the board of recreation and arts commissioners shall also be a member of the board of park commissioners; this member ' s term shall run for the same period of time as the term on the park board. (b) At its first meeting in October, the board of recreation and arts commissioners shall elect a chairperson, vice-chairperson, and a secretary who shall serve for a one ( 1 ) year term. The chair shall decide on all points of order and procedure, subject to these rules, unless directed otherwise by a majority of the board members in session at the time. The chair shall appoint any standing or temporary committees necessary to carry out the function of the commission. The chair shall sign all resolutions and legal documents as the representative of the board. The keeping of the minutes may be delegated to the director of recreation' s secretary. In the absence of the chair, the vice-chair shall be the presiding officer. (c) On the second Monday in September, the Mayor with the approval of the Council, shall appoint commissioners to succeed commissioners retiring on the following first day of October, who shall hold office for three ( 3 ) years from the first day of October. The commissioners shall hold their office until their successors are appointed and qualified. BOOR PAGE Ordinance No. 3610 Page 2 Sec. 28-19 . Person eligible for membership. Qualified electors of the City are eligible to membership on the Board of Recreation and Arts Commissioners. One member of the Board of Park Commissioners shall also be a member of the Board of Recreation and Arts Commissioners. Sec. 28-20. Compensation of members. Members of the Board of Recreation and Arts Commissioners shall receive no compensation for their services. Sec. 28-21 . Acts which will render office of member vacant. The removal of any member of the Board of Recreation and Arts Commissioners permanently from the City, or his/her absence from six ( 6) consecutive meetings of the Board, except in case of sickness or temporary absence from the City, without due explanation, shall render his/her office as a member vacant. Sec. 28-22. Filling vacancies. Vacancies occurring on the Board of Recreation and Arts Commissioners shall be filled by the Mayor in the same manner as regular appointments, which appointment shall be to fill out the unexpired term for which the appointment is made. Sec. 28-23 . Authority of the board. The Board of Recreation and Arts Commissioners shall have and exercise the following powers: (a) Jurisdiction. To have exclusive control of the Recreation and Arts Center, Byrnes and Gates swimming pools, and facilities acquired by it or of any other property owned or leased by the City and set apart to be managed by the Board of Recreation and Arts Commissioners. (b) General powers. To direct and control all of the affairs of the Recreation and Arts Commission. To make recommendations to the Mayor and City Council to employ a director of recreation and such assistants and employees as may be deemed necessary for the proper management of the Recreation Department facilities and programs. (c) Leasing to organizations. To lease, under reasonable rules and requirements, a particular recreation property, or portion thereof, or any building, or portion thereof, under the jurisdiction of the Recreation and Arts Commission for a period not to exceed one ( 1 ) year, subject to renewal, to any organization or individual( s) deemed appropriate and acceptable by the Board. (d) Board meetings. Regular meetings shall be held, at a minimum, on a monthly basis on the second Thursday of each month at the Recreation and Arts Center. Special meetings of the board may be called by the chair. All meetings shall be open to the public. A quorum shall consist of a majority of the commissioners. The business of regular meetings shall consist of : (a) approval of the minutes of preceding meeting; (b) reports; (c) unfinished business; (d) new business; (e) approval of bills. BOOK 283 PACE 8 Ordinance No. 3610 Page 3 Sec. 28-24 . To keep a record of its proceedings. The Board of Recreation and Arts Commissioners shall keep a record of its proceedings. Sec. 28-25 . Disposition of funds; disbursements. The Board shall have the power to establish charges and disburse moneys received in accordance with approved City procedures. The Council may annually appropriate a sum of money from the general funds for the payment of the expense of such commission. (a) Expenditure of Funds. The Commissioners shall have authority to expend for and on behalf of such municipality all sums of money so appropriated except that all purchases of goods and services shall be made in accordance with the City' s established rules and regulations and especially those sections relating to open competitive bidding. (b) Grants, gifts and donations. All grants, gifts, donations or payments whatsoever which are received by such municipality for Board of Recreation and Arts Commission improvement purposes shall be placed in the Board of Recreation and Arts Commissioners funds or in the Waterloo Civic Foundation to be used by said commissioners in the manner and for the purposes designated by this division. (c) Debt-contracting powers. The commissioners shall have no power to contract debts beyond the amount of the Board' s income for the current year. Sec. 28-26. Annual Report. The Board of Recreation and Arts Commissioners shall keep a record of its proceedings. Furthermore, the Board shall make an annual, detailed report to the City Council immediately after the close of each municipal calendar year of the amounts of money expended and the purposes for which used and such annual statement shall be published as part of the annual municipal report.
