AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
WATERLOO, IOWA, BY REPEALING SECTION 2-192 ( CREATION ;
PURPOSE ) ; SUBSECTIONS ( 1 ) , ( 3 ) AND ( 5 ) OF SECTION 2-193
( BOARD ORGANIZATION ) ; SECTION 2-194 ( POWERS AND DUTIES OF THE
BOARD ) ; SUBSECTION ( 2 ) OF SECTION 2-195 ( CONTROL AND
DISBURSEMENT OF FUNDS ) ; AND SECTION 2-195 . 1 ( RECORD OF
PROCEEDINGS AND ANNUAL REPORT ) OF DIVISION 4, BOARD OF PARK
COMMISSIONERS, OF CHAPTER 2, ADMINISTRATION ; AND
BY ENACTING IN LIEU THEREOF NEW SECTION 2-192 ( CREATION ;
PURPOSE ) ; SUBSECTIONS ( 1 ) , ( 3 ) AND ( 5 ) OF SECTION 2-193
( BOARD ORGANIZATION ) ; SECTION 2-194 ( POWERS AND DUTIES OF THE
BOARD ) ; SUBSECTION ( 2 ) OF SECTION 2-195 (CONTROL AND
DISBURSEMENT OF FUNDS ) ; AND SECTION 2-195 . 1 ( RECORD OF
PROCEEDINGS AND ANNUAL REPORT) OF DIVISION 4, BOARD OF PARK
COMMISSIONERS, OF CHAPTER 2, ADMINISTRATION .
BE IT ORDAINED by the City Council of the City of Waterloo , Iowa :
That Section 2-192; Subsections ( 1 ) , ( 3) and ( 5) of Section
2-193 ; Section 2- 194 ; Subsection ( 2 ) of Section 2-195 ; and Section
2-195 . 1 of Division 4 , Board of Park Commissioners , of Chapter 2,
Administration, are hereby repealed in their entirety.
That new Section 2-192; Subsections ( 1 ) , ( 3) and ( 5) of Section
2-193 ; Section 2- 194 ; Subsection ( 2 ) of Section 2-195 ; and Section
2-195 . 1 of Division 4, Board of Park Commissioners , of Chapter 2,
Administration , are hereby enacted in lieu thereof as follows :
DIVISION 4 . BOARD OF PARK COMMISSIONERS
Sec . 2 - 192 . Creation ; purpose .
There shall be reestablished a board of park commissioners to
promote the orderly acquisition , development , preservation ,
management and control of the park system operation and riverfront
properties and facilities for the inspiration , use and enjoyment
of the citizens .
Sec . 2-193 . Board organization .
( 1 ) Membership ; term. The board of park commissioners shall
consist of five ( 5 ) members to be appointed by the mayor with the
approval of the council . The regular, full term of office shall
be six (6 ) years , with one member ' s term expiring every two ( 2 )
years on December 31 . The commissioners shall hold their office
until their successors are appointed and qualified . Said
appointments to be made upon the expiration of each present
elected term of office .
( 3) Compensation of members . Each of the commissioners shall
serve on the board without compensation .
( 5 ) Officers and duties . The officers of the board shall be
chairman and secretary . At its first organizational meeting, held
in January of each year , the board of park commissioners shall
elect a chairman and secretary who shall serve for such a term as
the board shall determine .
The chairman shall decide on all points of order and procedure ,
subject to these rules , unless directed otherwise by a majority of
the board members in session at the time . The chairman shall
appoint any committee found necessary to investigate any matter
before the board .
The chairman shall sign all resolutions and legal documents as the
representative of the board . The keeping of minutes may be
delegated to the director of parks or park department office
secretary.
In the absence of the chairman , the secretary shall be the
presiding officer .

Sec . 2-194. Powers and duties of the board .
The board of park commissioners shall have and exercise the
following powers :
( 1 ) Jurisdiction . To have exclusive control of parks , riverfront
land and facilities acquired by it or of any other property owned
by the city and set apart for like purposes .
( 2) General powers . To direct and control all of the affairs of
the park commission .
To employ a director of parks in accordance with the civil service
regulations as set out in Chapter 400, Code of Iowa.
To empower the director of parks to hire such assistants and
employees as may be deemed necessary for the proper management of
the park system and riverfront lands and facilities .
May recommend to the City Council the appropriate employee or
employees of the Park Department as a peace officer to enforce the
laws , rules and regulations of the parks and riverfront lands in
the City of Waterloo .
( 3) Acquisition and sale of real estate . To have the power to
acquire real estate, within or without the city, for park purposes
by donation , lease, purchase or condemnation , take title to real
estate in the name of the City of Waterloo in trust for public
park purposes and hold it exempt from taxation .
To sell , subject to the approval of the city council , exchange or
lease any real estate acquired by it which shall be found unfit or
not desirable, unnecessary or not required for park purposes .
To make recommendations to the City Council regarding the exercise
of the use of eminent domain for the acquisition of real or
personal property for the purpose of public parks and riverfront
lands within the City of Waterloo .
( 4 ) Leasing to organizations . To lease, under reasonable rules
and requirements , a particular park or riverfront property, or
portion thereof, or any building , or portion thereof , located on
park or riverfront property, or a portion thereof, under their
jurisdiction for a period not to exceed one ( 1 ) year , subject to
renewal , to any organization or individual deemed appropriate and
acceptable by the board .
( 5 ) Board meetings . Regular meetings shall be held , at a
minimum, on a monthly basis on the second Thursday of each month
in the offices of the board . Special meetings of the board may be
called by the chairman . All meetings shall be open to the public .
A quorum shall consist of a majority of the commissioners . The
business of regular meetings shall consist of ( a) approval of the
minutes of preceding meeting ; ( b ) reports ; ( c ) unfinished
business ; ( d) new business ; (e ) approval of bills .
Sec . 2- 195. Control and disbursement of funds .
( 2) Grants , gifts and donations . All grants , gifts , donations or
payments whatsoever which are received by such municipality for
board of park commissioners and riverfront improvement purposes
shall be placed in the board of park commissioners funds , to be
used by said commissioners in the manner and for the purposes
designated by this division .

Sec . 2-195 . 1 . Record of proceedings and annual report .
The board of park commissioners shall keep a record of its
proceedings . Furthermore, the board shall make an annual ,
detailed report to the city council immediately after the close of
each municipal calendar year of the amounts of money expended and
the purposes for which used, and such annual statement shall be
published as part of the annual municipal report .
