AN ORDINANCE AMENDING THE 1988 TRAFFIC CODE BY
REPEALING SECTION ( 307) , AUTHORITY TO IMPOUND VEHICLES:
AND BY ENACTING IN LIEU THEREOF A NEW SECTION ( 307 ) ,
AUTHORITY TO IMPOUND VEHICLES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA as follows:
That Section ( 307 ) , Authority to Impound Vehicles, of the
1988 Traffic Code, is hereby repealed in its entirety; that a new
Section ( 307 ) , Authority to Impound Vehicles, of the 1988 Traffic
Code is hereby enacted in lieu thereof as follows:
Members of the Police Department are hereby authorized to
remove or have removed any abandoned vehicle from a street,
public alley or highway to the nearest garage or other place of
safety, or to a garage designated or maintained by the Police
Department or otherwise maintained by the City, under the
circumstances herein enumerated:
1 . "Abandoned vehicle" means any of the following:
a. A vehicle that has been left unattended on public
property for more than 48 hours and lacks current registration
plates or two or more wheels or other parts which renders the
vehicle totally inoperable.
b. A vehicle that has remained parked upon a public
street, municipal parking lot, alley or highway for a continuous
period of 72 hours or more.
c. A vehicle that has been unlawfully parked on
private property or has been placed on private property without
the consent of the owner or person in control of the property for
more than 24 hours.
d. A vehicle that has been legally impounded by order
of a police authority and has not been reclaimed for a period of
ten days.
e. Any vehicle parked on the highway determined by
police authority to create a hazard to other vehicle traffic.
2 . A vehicle shall not be considered abandoned for a period
of five days if its owner or operator is unable to move the
vehicle and notifies the Police Department and requests
assistance in the removal of the vehicle.
3 . When any vehicle has been impounded by the Police
Department, the Department shall give notice to owners,
lienholders, and other claimants pursuant to Section 321 . 89 of
the Code of Iowa.
4 . If an abandoned vehicle has not been reclaimed as
provided for in State Code, the Department shall have the
authority to dispose of abandoned vehicle pursuant to Section
321 . 89 of the Code of Iowa.
5. The owner or driver of any vehicle impounded for a
violation of any of the provisions of this Ordinance shall be
required to pay the cost of towing and storage.
