AN ORDINANCE AMENDING THE TRAFFIC CODE BY REPEALING SECTION 16,
REPORTS CONFIDENTIAL - WITHOUT PREJUDICE, AND ENACTING IN LIEU
THEREOF A NEW SECTION 16, REPORTS CONFIDENTIAL - WITHOUT
PREJUDICE.
BE IT ORDAINED by the City Council of the City of Waterloo, Iowa:
That Section 16, Reports Confidential - Without Prejudice, of the
Traffic Code of the City of Waterloo, Iowa, is hereby repealed in its
entirety; that new Section 16, Reports Confidential - Without
Prejudice, of the Traffic Code of the City of Waterloo, Iowa, is
hereby enacted in lieu thereof as follows:
SEC. 16. REPORTS CONFIDENTIAL - WITHOUT PREJUDICE.
All accident reports filed by a driver of a vehicle involved in
an accident as required under this code and under Section 321.266 of
the Code of Iowa shall be in writing. The report shall be without
prejudice to the individual so reporting and shall be for the
confidential use of the department, except that upon the request of
any person involved in the accident, his insurance company or its
agent, or the attorney for such person, the department shall disclose
the identity and address of the person involved in the accident. The
written report filed with the department shall not be admissible in
or used in evidence in any civil or criminal case arising out of the
facts on which the report is based.
All written reports filed by a law enforcement officer as
required under Section 321.266 of the Code of Iowa shall be made
available to any party to an accident, his insurance company or its
agent, or his attorney on written request to the office of the Chief
of Police and payment of a fee. The fee for the copying service as
determined by the Chief of Police shall not exceed the cost of
providing the service.
PASSED AND ADOPTED by the City Council this 21 day of October,
1985, and approved by the Mayor this 22 day of October,
1985.
