BE IT ORDAINED BY TIE COUNCIL OF THE CITY OF WATERLOO, BLACK HAWK
COUNTY, I(WA:
That Section 33-76.2, Location of Bus Benches, of the Bus Stop
Bench Ordinance No. 3226, is hereby repealed in its entirety; and
That Section 33-76.2, Location of Bus Stop Benches, of the Bus
Stop Bench Ordinance No. 3226, is hereby enacted in lieu thereof as
follows:
SECTION 33-76.2. LOCATION OF BUS STOP BENCHES.
The placement of bus stop benches shall he
limited to MET designated bus stops only.
These designated his stops nay vary in number
and location from time to time. In addition,
bus stop benches shall conform to the following
regulations:
a) The location of all bas stop benches shall
be reviewed by the Planning, Programming
and Zoning Department and the City

c) Bus stop benches shall be placed on public
property parallel to street along MFf
designated bus routes and shall further be
limited to areas where there is a minimum
of six (6) feet from curb or edge of the
roadway to front of bench.
d) City Engineering Department shall
periodically inspect all bus stop benches
for maintenance, safety and site Location.
e) Bus stop benches shall be placed no closer
than three (3) blocks or nine hundred (POP)
feet, whichever is more restrictive, from
any other his stop bench along any
individual MET designated bus route.
f) In the event .1ET reduces or alters a route
at any tine during the year, requests for
relocations may be submitted upon written
notice from HET of route Changes and number
of benches affected by company name.
That Section 33-76.3, Application for Permit to be Submitted to
Appropriate City Departments, of the Bus Stop Bench Ordinance No. 3226,
is hereby repealed in its entirety; and
That Section. 33-76.3, Application for Sign Permit to be Submitted
to Appropriate City Departments, of the Bus Stop Bench Ordinance No.
3226, is hereby enacted in lieu thereof as follows:
SECTION 33-76.3. APPLICATION FOR SIGN PERMIT TO BE SUBMITTED TO
APPROPRIATE CITY PEPARITYENTS.
An applicant for a sign permit required by this
article shall submit a written application to
the City Building Official.
An application may be submitted for one (1) bus
stop bench and one (1 ) permit may be issued for
one (1) bus stop bench, provided that fee
required herein accompany the same and the
location of the bus stop bench has received
approval from the appropriate depaLLments.
The Building Official, within seven (7) days of
receipt of the application, for a. sign permit,
shall approve or disapprove the application.
If the Building Official disapproves the
application, the reason for the disapproval
shall be stated in writing and given to the
applicant.
That Section 33-7( .4, Permit Required to install and Maintain, of
the Bus Stop Bench Ordinance No. 3226, is hereby repealed in its
entirety; and.
That Section 33-76.4, Permit Required to Install and Maintain, of
the Bus Stop Ordinance No. 3226, is hereby enacted in lieu thereof as
follows:

SECTION 33-76.4. PERMIT RETI. IIRM In INSTALL AND MAINTAIN.
No his stop bench shall be installed unless a
permit has been obtained from the City -.Building
Official, xtho has vested authority to issue
these permits. The permit shall be affixed to
base of lynch in such a manner that it may he
visible from the street.
That 33.76.6, Permit Fees, of the Bus Stop Bench Ordinance No.
• 3226, is hereby repealed in its entirety; and
Mat Section 33-76.6, Bus Stop Bench Fees, of the Bus Stop Bench
Ordinance No. 33-76.6, is hereby enacted in lieu thereof as follows:
SECrION 33-76.6 BUS STOP BENCH FEES.
.A. nonrefundable fee of fifteen dollars ($15.00)
shall accompany each new location application
form and a nonrefundable fee of seven dollars
and fifty cents ($7.50) shall accompany each
relocation request. These fees are assessed
for each individual bus stop bench and fifteen
dollars ($15.00) shall be an annual fee due on
the first day of April. every year.
A sign permit fee required by this article
shall be accompanied by a fee of twenty-five
(S25.00) for each bus step bench and shall only
be issued after the location of the bus stop
bench has been revioged and approved by the
appropriate departments.
That Section 33,76.7, Evidence of Public Liability Insurance, of
the Bus Stop Bench Ordinance Mo. 3226, is hereby repealed in its
entirety; and
That Section 33.76.7, !''.;vidence of Public Liability Insurance, of
the Bus Stop Bench Ordinance No. :3226, is hereby enacted in nal
thereof as follows:
SECTI( 33-76.7. EVIDENCE OF PUBLIC LIABILIrsi
The permittee shall file a Certificate of
Insurance with the Clerk of the City of
Waterloo, which shall name the City as an
additional insured and shall be maintained in
the amount of three hundred thousand dollars
($300,000.00) for liability coverage. The
permittee shall.. also enter into an agreenent
with the City to indemnify the City for any and
all, liability which nay arise out of the use of
the bus stop bench.
That Section 33-76.8, Permittee Responsibilities, of the Bus Stop
Bench Ordinance No. 3226, is hereby repealed in its entirety; and

That Section 33.76.8, Permittee Responsibilities, of the Bus Stop
Bench Ordinance No. 3226, is hereby enacted in lieu thereof as
follows:
SFCTION 33-76.3. PEP11ITTEE RESPONSIBILITIES.
By acceptance of a permit reouired by this
division, the permittee agrees to be bound by
this division and further agrees to inspect
each his stop bench and to maintain the his
stop benches in a safe, clean and sightly
condition.
That Section 33-76.11 , Removal of Illegal Bus Stop Benches, of the
Bus Stop Bench Ordinance No. 3226, is hereby repealed in its entirety;
and
That Section 33-76.11 , Removal of Illegal Bus Stop Benches, of the
Bus stop Bench Ordinance No. 3226, is hereby enacted in lieu. thereof as
follows:
Section 33-76.11 . REMOVAL OF ILLEGAL BUS STOP BENCHES.
Should any bus stop bench be found to be in
noncompliance with this division or if
complaints are received by the City of Waterloo
concerning. the placement of any bus stop bench,
the permittee shall be given a written notice
from the City by regular rail, to bring the
bench into compliance. If the bus stop bench
is not brought into compliance within ten (10)
days after the notice has been mailed, a
hearing will be held and a decision shall be
rendered which nay lead to removal and
retaining said bench as the property of the
City of Waterloo and the location will
subsequently be disallowed in the future. All
existing Bus Stop Benches shall be in
compliance within one (1) year after passage of
this ordinance.
