Moved by Welper, seconded by Steve Schmitt that the Agenda, as proposed, be approved. Ayes: Seven. Motion carried. Mayor Pro Tem Reggie Schmitt reviewed proposed changes to the liquor control ordinance as it pertains to Section 3-2-6, Conditions of License or Permit. No premises having a liquor license or beer permit shall be allowed to located within 500 feet of a public or private educational institution, preschool or daycare facility, place of worship or any other premises having a liquor license or beer permit for any new license or permit issued after May 1, 2009. The changes also will allow a transfer of a license or permit from one location to another if the premises to which the transfer is made would have been eligible for a license or permit and will not result in the violation of any law or ordinance. Councilperson Cole expressed concern with prohibiting a new establishment from locating within 500 feet from any other business with a liquor or beer permit because we have been encouraging an entertainment center downtown and already have businesses located within 500 feet of each other. Mayor Pro Tem Reggie Schmitt noted the proposed changes are only for new businesses. Councilperson Getty stated he has concerns with Subsection B2 which says the entrance of the business must have a door or window which provides an unobstructed view of the main seating and/or serving area of the business with minimum of 9"x9" window at eye level and approximately 56" to 64" above the ground level. Councilperson Getty noted there currently are businesses that would be non -complaint. Councilperson Getty suggested requiring the door to have a glass window without the requirement of an unobstructed view of the main seating area. Tom Jennings, Police Chief, explained that the Police Department initially required the window and unobstructed view. It was the intent that police officers would be able to see inside to the business before they walk into it. Councilperson Getty suggested that the language be changed to say as long as they have a door with a window and a long hall way. It was the consensus of the council to have Chris Wendland make revisions and then forward to place it on the council agenda. Mayor Pro Tem Reggie Schmitt reviewed changes to the Dangerous Animals and Dogs Ordinance. The proposed changes include changes to definitions of what is a dangerous animal. In addition, it makes exceptions for constricting snakes whose adult length is less than six feet. It also includes keeping of dangerous animals for religious practices and at educational or medical institutions or museums. It allows for certain animals to be kept for farming purposes as long as they meet the zoning requirements. The consensus of the council was to place the changes to the Dangerous Animals and Dogs Ordinance on the April 20, 2009 council agenda. With no further business before the council, it was moved by Welper, seconded by Steve Schmitt that the meeting be adjourned at 4:55 p.m. Ayes: Seven. Motion carried. Nancy Eckert City Clerk
