Members absent: Greenwood, Steve Schmitt. Moved by Reggie Schmitt, seconded by Welper that the Agenda, as proposed, be approved. Ayes: Five. Absent: Greenwood, Steve Schmitt. Motion carried. Mayor Hurley reviewed items on the Standing Committee agendas for meetings scheduled for Monday, July 13, 2009. Eric Thorson, City Engineer, discussed the sale of salvaged bricks to Gavin Historical Brick which is on the Public Works Committee agenda. Gavin will purchase the brick pavers from the city for $10,000.00. Gavin will make the brick pavers available to the public for a price of $.65 each on two consecutive Saturdays from 9:00 a.m. to 2:00 p.m. Mayor Hurley reviewed items on the council agenda for Monday, July 13, 2009 and the following items were discussed. Mayor Hurley noted that a noise variance request from Noel Anderson for July 11, 2009 from 5:00 p.m. to 10:00 p.m. in conjunction with a band playing at a party at 209 Alice Avenue is on the consent agenda, and he asked consensus of the council because the party is before the July 13, 2009 council meeting. Census of the council was approval of the request. Mayor Hurley noted that the professional services agreement with Struxture Architect for the design, bidding process and contract documents for the new Fire Station #8 is on the agenda. Mayor Hurley noted that the bids for the new Fire Station #8 were higher than anticipated, and the city has contacted CVS to let them know, but we still have to pay Struxture. Mayor Hurley explained that he and staff are meeting today to prioritize list for the State of Iowa I -Jobs Program. The Notice of Intent is on the agenda and he will pass along the list to the council. Councilperson Getty noted that the 600 foot rail spur off Lafayette Street is on the agenda, and he asked if the city received permission from the railroad to cross their tracks for the cleanup. Mayor Hurley responded that the railroad asked the city to pay too much money to cross their tracks and the city is using a different access point that is working. Mayor Hurley noted that changes to the General Rules of Public Participation at City Council meetings is on the agenda. Mayor Hurley stated that there has been conversations and Call The Courier regarding whether the rules allow for public comments for any items and not just public hearings. The wording has been changed that at the discretion of the chair/presider a citizen may address an item. Also a number has been adding concerning public comments during public hearings. Councilperson Getty stated that he has received phones regarding vendors who have mobile concession stands and trailers at the liquor store outlets. Councilperson Getty stated he thought they were to be moved and cleaned every night. Councilperson Getty noted that the city does not regulate those stands, but Black Hawk County Health Department does inspect and license them and asked Lou Cutwright to get with the Health Department to see if something can be done. Mayor Hurley noted they are not allowed on city property, but they are allowed on private property. With no further business before the council, it was moved by Cole, seconded by Getty that the meeting be adjourned at 8:20 a.m. Ayes: Five. Absent: Greenwood, Steve Schmitt. Motion carried.
