HomeMy WebLinkAbout07.23.2009• • COUNCIL WORK SESSION July 23, 2009 8:00 a.m. Council Chambers Members present: Mayor Pro Tem Reggie Schmitt, Cole, Getty, Hart, Steve Schmitt, Welper, Reggie Schmitt. Members absent: Greenwood. Moved by Welper, seconded by Steve Schmitt that the Agenda, as proposed, be approved. Ayes: Six. Absent: Greenwood. Motion carried. Mayor Pro Tem Reggie Schmitt reviewed items on the Standing Committee agendas for meetings scheduled for Monday, July 27, 2009. Mayor Pro Tem reviewed items on the July 27, 2009 council agenda and the following items were discussed. Councilperson Hart asked if the rezoning request from John Rice for property located at 2260 Independence Avenue for an auto sales lot is for a new business. Noel Anderson, Community Planning & Development, explained that Mr. Rice is changing the permitted use. Mr. Anderson stated he believes Dwayne Eilers, the current property owner, will be selling the property to Mr. Rice. Councilperson Hart asked if a decision has been made on appointment of members of the committee for the search for a new city clerk. Councilperson Reggie Schmitt responded that Mayor Hurley appointed Councilperson Welper as the chair and Welper will be appointing a search committee. Councilperson Reggie Schmitt noted that the Human Resources Committee will authorize to begin the recruitment and hiring process for the City Clerk. Councilperson Steve Schmitt asked if the city bid out the professional services agreement for the storm water utility fee. Eric Thorson, City Engineer, stated they interviewed a couple of companies. Snyder & Associates have experience in this type of work, and they said they could meet our deadline. Councilperson Steve Schmitt asked who makes the decision about the speed humps. Councilperson Reggie Schmitt stated the public submits a petition to the Traffic Operations Department, they review the request and then forward the recommendation to the council. Councilperson Getty stated he received a few phone calls regarding John Rice's rezoning request at 2260 Independence Avenue, and they were objecting to the used car lot and auto repair business. There has been trouble with the current property owner. Councilperson Getty stated it is his understanding that Mr. Rice will lease the property from Mr. Eilers. Aric Schroeder, City Planner, stated that Mr. Rice is looking at leasing the property from Mr. Eilers with an option to purchase. Councilperson Getty stated he has a problem changing the zoning on this property if Mr. Eilers will continue to own the property, and he will not support the rezoning request. Mr. Schroeder noted that the request is for "C-2" Commercial District With Conditions. Mr. Rice is required to sign a restrictive covenant and has to agree to all the conditions. With no further business before the council, it was moved by Cole, seconded by Welper that the meeting be adjourned at 8:12 a.m. Ayes: Six. Absent: Greenwood. Motion carried. Nancy Eckert City Clerk
