Moved by Hart, seconded by Getty that the Agenda, as proposed be approved. Ayes: Four. Absent: Greenwood, Steve Schmitt, Reggie Schmitt. Motion carried. Councilperson Welper reviewed items on the Standing Committees for meetings scheduled for Monday, September 28, 2009. Councilperson Welper reviewed items on the council agenda for Monday, September 28, 2009 and the following items were discussed. Councilperson Welper noted that the resolution of intent to amend the franchise agreement with Mediacom is part of the presentation at last Monday's work session to change PEG access channels from analog to digital. An ordinance will be placed on the October 5, 2009 agenda to amend the franchise agreement. With the resolution Mediacom is looking for consensus from the council as to whether to move forward with the transition. Councilperson Getty inquired about the new liquor license at 120 Sumner Street. City Clerk Nancy Eckert explained that it is a new license, but there was already an establishment at this location, which is allowed by the moratorium. New World Lounge lost its lease and wants to move to the former Broadway Diner location, which is not allowed by the moratorium. Aric Schroeder, City Planner, reported that Planning and Zoning continues to work on the language for the zoning amendment. The proposed language will be reviewed by the Planning, Programming and Zoning Commission at its October meeting, and then forwarded to full council. The opinion of the City Attorney is that if new establishment wants to open at an address where there already was a liquor establishment, they would be allowed as legal non- conformance. If the use is abandoned for more than one year no new establishment could locate there. Eric Thorson, City Engineer, reported that the Cedar River Water Trail project is for the portages around the dam at East Park and East 4th Street. With no further business before the council, it was moved by Hart, seconded by Cole that the meeting be adjourned at 8:15 a.m. Ayes: Four. Absent: Greenwood, Steve Schmitt, Reggie Schmitt.
