Members absent: Hart. Moved by Welper, seconded by Steve Schmitt that the Agenda, as proposed, be approved. Ayes: Six. Absent: Hart. Motion carried. Mayor Pro Tem Reggie Schmitt reviewed items on the Standing Committee agendas for meetings scheduled for Monday, July 7, 2008. Mayor Pro Tem Reggie Schmitt reviewed items on the council agenda for Monday, July 7, 2008, and the following items were discussed. Police Chief Tom Jennings reviewed his reasons for denying the request of the Crew M.C. for a noise variance at 830 W. Donald Street on July 12, 2008. This is a residential area, this is an organization from outside the area, and the notice says if you are under 21 or offended, don't attend. The notice also says they will pay for a resident to stay at a motel if they feel the noise is too loud. Council members discussed the request of the property owners at 815, 821 and 825 Bayard Street to vacate approximately 150 feet of public sidewalk. Planning, Programming and Zoning Commission have recommended approval. Councilperson Cole noted she drove by the addresses and feels the residents make a good case, and she is glad PPZ recommended approval. Councilperson Reggie Schmitt noted that the owners will have to remove the sidewalks at their expense. The agreement with VJ Engineering to perform a structural review and assessment of the boat house building in the Cedar River Park as it relates to flood damage. The assessment is necessary to apply for FEMA funds. Louis Cutwright, Building Official/Maintenance Administrator, noted that the Building Inspection Department believes the building should be demolished, and this study will tell Leisure Services what needs to be done. The request from the Community Development Director to pay $27,202.88 from Local Housing Assistance Program Housing Trust Fund to reimburse Community Development Block Grant (CDBG) account in conjunction with St. Mary's Villa, 123 E. Parker Street, was discussed. Representatives of Queen of Peace, the previous deed holders, have agreed to pay $10,000.0. The city originally awarded Queen of Peace funds from the CDBG. The property was transferred to another entity in December 2006, which does not qualify under CDBG. The proposed transaction is recommended by the U.S. Department of Housing and Urban Development for compliance. With no further business before the council, it was moved by Getty, seconded by Cole that the meeting be adjourned at 8:22 a.m. Ayes: Six. Absent: Hart. Motion carried. Nancy Eckert City Clerk
