Moved by Welper, seconded by Greenwood that the Agenda, as proposed, be approved. Ayes: Five. Absent: Hart, Steve Schmitt. Motion carried. Mayor Pro Tem Reggie Schmitt reviewed items on the Standing Committee agendas for meetings scheduled for Monday, December 8, 2008. Mayor Pro Tem Reggie Schmitt reviewed items on the council agenda for Monday, December 8, 2008 and the following items were discussed. The request of Officer Steve Bose for a variance to the city's residency policy to allow him to live in Oelwein, Iowa. Council members discussed if a timeline should be considered as to when this would be revisited. Police Chief Jennings noted that Officer Bose would like to be treated the same as the other requests. The acceptance of work performed by Bentley Construction for the F.Y. 2009 Sidewalk Repair Assessment Program — Zone 8, Contract No. 746, was discussed. Councilperson Greenwood stated that he received a lot of phone calls regarding the quality of work and the way the yards were left. Eric Thorson, City Engineer, stated that the contractor has gone back and cleaned up the areas, but he is still waiting to receive the maintenance bond from the contractor. The Encroachment agreement with Fernando Malias to allow an emergency exit door at 728 Commercial Street to encroach approximately 35" into a public alley was discussed. A bar was given a permit from the Building Department for the work because a fire inspection required an emergency exit. When the emergency door is open. it sticks out about 36" into the public alley. If the agreement is not approved, the owner will have to tear out the new emergency exit door. With no further business before the council, it was moved by Cole, seconded by Greenwood that the meeting be adjourned at 8:12 a.m. Ayes: Five. Absent: Hart, Steve Schmitt. Motion carried.
