HomeMy WebLinkAbout08.21.2006ORDINANCE COMMITTEE August 21, 2006 4:50 p.m. Council Chambers Members present: Mayor Pro Tem Schmitt, Kincaid, Welper, Gunderson, Getty, Cole. Members absent: Greenwood. Moved by Kincaid, seconded by Cole that the Agenda, as proposed, be approved. Ayes: Six. Absent: Greenwood. Motion carried. The purpose of the meeting was to discuss a proposed ordinance regulating semi tractor and semi trailer parking in residential areas. The proposed ordinance would prohibit the parking of a semi tractor or semi trailer in a residential area of the city between the hours of 9:00 p.m. and 7:00 a.m. on any day. The code enforcement officers have received complaints from areas in the city, including Locke Avenue, Graceline, Bishop, and Cataract Avenue regarding over -the -road truckers taking their cabs home. Councilperson Cole asked what would be the alternative for parking for people who make a living driving a semi tractor or semi trailer. Councilperson Gunderson noted some of the tractors and trailers are company owned so they wouldn't take them home. Councilperson Gunderson stated he feels the city is creating an ordinance for '/2 of 1 percent of the population, and we can't create an ordinance for everything. Councilperson Gunderson noted the current ordinance allows them to park on cement, and the maintenance code regulates parking on the grass. Councilperson Gunderson stated he cannot go along with adopting this ordinance. Councilperson Schmitt stated he received e-mails regarding this issue, and he feels this is just the tip of the iceberg. There are a lot of over -the -road truckers who travel just one day, and there are many businesses that did not exist five years ago. Councilperson Schmitt stated there is no problem with commercial truckers and parking the semi tractors and semi trailers during the day. Councilperson Kincaid stated on Newell and East 4th Street there was a hazardous condition, and he talked with Police Chief Tom Jennings about the ordinance. It is legal in the current ordinance to park on the street, but not on the grass. Councilperson Kincaid stated he has truckers who park their tractors in residential areas on the weekends. Councilperson Getty reported he has a tractor down the road from his home that parks in a "no parking here to corner" area. Moved by Getty, seconded by Schmitt that the proposed ordinance be forwarded to the regular council agenda. Councilperson Welper suggested the council have additional discussion to come up with a solution. Councilperson Getty stated he does not think semi tractors and semi trailers should be allowed to park in residential areas. A vote was taken on the above motion with the following result. Ayes: Two. Nays: Kincaid, Welper, Gunderson, Cole. Absent: Greenwood. Motion failed. With no further business before the council, it was moved by Gunderson, seconded by Cole that the meeting be adjourned at 5:02 p.m. Ayes: Six. Absent: Greenwood. Motion carried.
