Members absent: Greenwood, Gunderson. Moved by Welper, seconded by Kincaid that the Agenda, as proposed, be approved. Ayes: Five. Absent: Greenwood, Gunderson. Motion carried. Items that are on the council agenda for Monday, March 21, 2005, were discussed with department heads who have items on the agenda. Mayor Hurley reviewed the Standing Committee agendas for Monday, March 21, 2005. Items discussed included: 1. The request of Iowa Post Frame Builders to rezone from "R-2" to "R-4" property generally located at the corner of Broadway and Virginia Streets for the purpose of constructing a new multiple housing complex unit. A hearing will be held on April 11. They wanted to build seven units, but the Planning, Programming and Zoning Commission approved four units. The site plan calls for an eight -stall garage to be included. Councilperson Clark stated he would like to send it back to the Planning, Programming and Zoning Commission for them to look at the eight -stall garage request. 2. The agreement with Isle of Capri and Black Hawk County Gaming Association which establishes a development fee for the city equal to .5 percent of each week's adjusted gross receipts and on the third anniversary date of commencement of operations the fee would increase to 1 percent of each week's adjusted gross receipts and payment of $1 million on the date of the issuance of the gambling license. Don Hoth reviewed the agreement. Mr. Hoth reported their application was due to the Iowa Gaming Commission on November 10, 2004 and no changes would be allowed to the application after that date. Their application included a 1 percent admission fee to go to the city. IOC and Black Hawk County Gaming Association have had two meetings with the Iowa Gaming Commission and the application has been approved. The city is entitle to charge an admission fee of fifty cents if the gambling facility is located in the city. The Isle of Capri has agreed to a 1 percent development charge in lieu of the admission fee. The agreement also includes a pledge of $1 million to WDC presumably to be used for the Riverfront Renaissance Project. Isle of Capri has agreed to advance $1 million to the city upon issuance of the license. Once Isle of Capri is operational, they would pay the city .5 percent of each week's adjusted gross receipts until the third anniversary when the fee would increase to 1 percent. The fees would be payable to the city every Friday at noon based on adjusted gross revenue. With no further business before the council, it was moved by Clark, seconded by Welper that the meeting be adjourned at 8:36 a.m. Ayes: Five. Absent: Greenwood, Gunderson. Motion carried.
