HomeMy WebLinkAbout07.19.2004• • ORDINANCE COMMITTEE July 19, 2004 4:15 p.m. Council Chambers Mayor Pro Tem Welper called the meeting to order at 4:36 p.m. Members present: Mayor Hurley, Welper, Kincaid, Cole, Greenwood, Clark, Schmitt, Gunderson. Moved by Kincaid, seconded by Gunderson that the Agenda, as proposed, be approved. Ayes: Seven. Motion carried. Lou Cutwright, Building Official/Maintenance Administrator, reviewed changes to Chapter 9, Manufactured Homes, of the 2001 Code of Ordinance as it pertains to area or width of manufactured homes in a lot of recording. In 1998 an ordinance change was adopted regulating manufactured homes that were erected on lots outside an approved mobile home or trailer park. The current discussions and influx of manufactured homes have uncovered a conflict between the zoning ordinance regulating single-family dwellings and the building ordinance regulating manufactured homes. State law addressing manufactured homes states that a municipality cannot adopt an ordinance that holds manufactured homes to a higher standard than normal stick -built homes. Section 9-9- 1(B)3 regulates that manufactured homes shall be placed on lots with a minimum width of 50' and a minimum area of 6,000 square feet. The zoning ordinance has the same requirement for stick -built homes. However, it does have an exception in that a stick -built home can be built on any "lot of record" in the city. Some platted lots in the city are 40" wide and less than 6,000 square feet in area. Mr. Cutwright is proposing that Section 9-9-1(B)3 read as follows: "The lot size of a manufactured home shall have a minimum width of fifty feet (50') and a minimum total square footage of six thousand (6,000) square feet. Exception: A manufactured home may be located on any lot or plot of official record as of the effective date of this ordinance regardless of its area or width. A "lot of record" is defined as: A lot which is a part of a subdivision recorded in the Office of the County Recorder of Black Hawk County, or a lot or parcel described by metes and bounds prior to February 7, 1969, the description of which has been so recorded." This change would alleviate the conflict in the ordinance and bring the city into compliance with state law. The council discussed the definition of trailer home, manufactured home and modular home. The council discussed the current issue with front entrance of manufactured home to be placed on the front of the building facing the street and addressed where it faces the street. Mr. Cutwright will forward the change to the ordinance to the full council for approval in a week or two. With no further business before the committee, it was moved by Gunderson, seconded by Cole that the meeting be adjourned at 4:50 p.m. Ayes: Seven. Motion carried. Nancy Eckert City Clerk
