HomeMy WebLinkAbout08.19.2004• COUNCIL WORK SESSION August 19, 2004 8:00 a.m. Council Chambers Members present: Mayor Hurley, Kincaid, Cole, Clark, Schmidt, Gunderson, Welper. Members absent: Greenwood. Moved by Welper, seconded by Kincaid that the Agenda, as proposed, be approved. Ayes: Six. Absent: Greenwood. Motion carried. Agenda items that have been placed on the council agenda of Monday, August 23, 2004 were reviewed with Department Heads who have placed items on the agenda. Mayor Hurley reviewed Standing Committee agendas for Monday, August 23, 2004. Items discussed included: 1. Superintendent of Waste Management's request to seek bids for roof repair to the maintenance shop. Funding has been identified. Tim Shea reported he is investigating if the roofing project would be EPA grant eligible. 2. A work session is being held to discuss the Riverfront Renaissance Plan. Representatives from Earth Tech and Vanderwalle & Associates will be at the meeti to discuss when the project will begin, what is included, how it is going to look and scheduling of the project. 3. Recycling Yard applications were discussed. These are the seven recycling yard operators who were denied a license and given 30 days to come in compliance. Staff has been working with them to come in compliance. Four operators are 1Working on installing the fence. Litzkow and Pat Rooff would not allow staff on their property for a final inspection, and they have filed a law suit appealing the city's denial of their license. 4. Norm Hayek's request to rezone from "A-1" to "R-1" property located west of Nottingham Addition for a future residential development. Some area residents thought this development would block Prescott Creek, but it will operate as currently does. Mr. Hayek is going to put in a private pond for this subdivision. 5. Request of David Deeds to rezone from "R-3" Multiple Residence District and "C-1" Commercial District to "R-3,R-P" Planned Residence District property located along East 8th Street and Lafayette Street for the purpose of constructing new single-family homes. Mr. Deed has been awarded HOME funds to help with this project. 6. The Animal Control Ordinance amendment as it pertains to animals On private property and off the property. Councilperson Gunderson asked that the requirement of a maximum six foot leash, rope, cord, chain or restraining device when the animal is off the property of the owner be removed from Item C. Moved by Gunderson, seconded by Welper that the language requiring a maximum of six feet when the animal is off the property of the owner but restrained by a leash, rope, cord, chain or restraining device be removed from Item C. Councilperson Welper stated up to Tuesday he was receiving positive comments and then he received a call asking why the council added the six foot maximum length and he could not think of an answer. Councilperson Gunderson commented that we will be penalizing 99 percent of the population while the other 1 percent will do what they want. Council Work Session August 19, 2004 Page 2 • • Councilperson Cole agreed with removing the six foot requirement stating sloe has received calls from vendors who install and use invisible fences. She stated this ordinance Ihas good intentions, but she feels it will be unenforceable. Councilperson Kincaid stated he would like to keep the six foot requirement jin the ordinance because the owners will be better able to control the animal in crowds. This will only be enforced on a complaint basis. Councilperson Schmitt stated he agreed with removing the six foot requirement as it is not enforceable and is just another way of penalizing those who have their anim41 under control. A vote was taken on the above motion with the following result. Ayes: Fou1r. Nays: Kincaid, Clark. Motion carried. 7. Reviewed the proposed amendments to the Zoning Ordinance pertaining to accessory building regulations and sign regulations. A work session will be held on September 13, 2004 to discuss the changes prior to the September 20, 2004 public hearings. With no further business before the committee, it was moved by Welper, seconded by Gunderson that the meeting be adjourned at 8:31 a.m. Ayes: Six. Absent: Greenwood Motion carried.
