Moved by Clark, seconded by Welper that the Agenda, as proposed, be approved. Ayes: Four. Absent: Hurley, Jordan. Motion carried. Noel Anderson, Assistant City Planner, and Don Temeyer, City Planner, reviewed the proposed policy for sale of buildable parcels of land. The proposed policy would require the council to look at each request individually due to unique circumstances, investment, community benefits and probable future uses of land. It is the understanding of staff the council would like to dispose of land not needed for future or present city purposes, but would also like to be cognizant of future land uses of each site and the implications of sale on future development opportunities. By allowing the offer amount to be lowered based on development plans, the council would be investing in the present developed areas and redevelopment similar to how they would donate land to industrial park project. Mr. Anderson discussed scenarios of what may happen for repayments. The repayment schedule for the CURA district was lengthened to continue to promote development within this area. The buildable vs. unbuildable status of land will take into account the size and orientation of the lot as well as the location and proximity to roads, infrastructure, etc. Mayor Rooff stated that the policy would require an applicant to pay 90 percent of the assessed value. The offer amount would be lowered for development purpose by figuring the taxes to be paid on the land for the proposed development. The goal would be to repay the difference within five years, eight years in the CURA district, and have development begun within two years. Councilperson Clark stated he would like the land to revert back to the city if development is not begun within two years. Mayor Rooff stated if the assessed value is higher than the appraised value than the city should use the appraised value. It was the consensus of the council to forward the policy to the council agenda. Mr. Anderson reviewed the proposed policy for unbuildable parcels of land. On unbuildable parcels of land the city would use the assessed value. If none is assigned, the city would use the price per square foot of abutting property. If the buyer does not agree with the price, staff will discuss the parcel with the applicant to see why they believe the parcel is worth less than the assessed value or using the abutting property price. Staff will also point out to the applicant the restrictions on the parcel that deem it is an unbuildable parcel. The council would take into account the intended use of the parcel, proposed buyer (whether or not an abutting property owner) and the community overall benefits or problems with sale of the parcel. Mr. Temeyer suggested that the council could use 50 percent of the minimum value. Councilperson Clark stated he feels this is a good guide rather than a policy because the policy allows the council to look at each request on a case -by -case basis. Councilperson Clark disagrees with calling this a policy, but that it should be a guide. Councilperson Clark stated he feels if only one person is interested in purchasing the unbuildable parcel the city should sell it to the applicant. Councilperson Clark stated he agrees that when property is purchased from the city the buyer must begin construction on the property within two years. No consensus was reached by the council on the policy for the unbuildable parcels of land, and the policy will be brought back for further consideration. With no further business before the council, it was moved by Getty, seconded by Clark that the meeting be adjourned at 5:12 p.m. Ayes: Four. Absent: Hurley, Jordan. Motion carried.
