Moved by Clark, seconded by Schmitt that the Agenda, as proposed, be approved. Ayes: Six. Absent: Cole. Motion carried. Lou Cutwright, Building Official/Maintenance Administrator, reviewed the proposed ordinance regulating the ADA Compliance Commission. The ADA Commission was established by resolution in 1992 with a five-year sunset clause. In 1997, it was reaffirmed for an additional five years. The ADA Commission has been a useful tool for the city in communicating with the disabled community. They have been instrumental in spearheading several projects, including the Falls/University Avenues Pedestrian Walkway. The commission would like to reestablish itself by ordinance rather than a resolution. The ADA Commission will consist of nine members. The majority of the commission shall be made up of people affected by disabilities. Commission members shall serve for three years, with three commissioners appointed for three years, three commissioners appointed for two years and three commissioners appointed for one year. All subsequent appointments shall be for a term of three years. The commission may make determinations of what is reasonable accommodations in public buildings and assist in the implementation /monitoring of the city's plan to bring city buildings into compliance with the Americans With Disabilities Act. The commission will establish and monitor a grievance procedure that will abate all ADA complaints on a local level. When requested, the commission will provide a grievance mediation on a case -by -case basis. Mr. Cutwright reported that the City Attorney will review the proposed ordinance prior to placing it on the council agenda. Mr. Cutwright reported that the city has spent over $1 million bringing city buildings into compliance with the Americans With Disabilities Act. Mr. Cutwright stated the commission felt they needed a nine member commission because of the diversity of disabilities in the community. Councilperson Schmitt suggested that the language be changed that would require the majority of the commission to be made up of people affected with disabilities. The language could say that the city will "endeavor" to appoint the majority of commission with people affected by disabilities. Moved by Gunderson, seconded by Kincaid that the Building Official/Maintenance Administrator be authorized to forward the proposed ordinance to the full council after the ordinance has been reviewed by the City Attorney. Ayes: Six. Absent: Cole. Motion carried. With no further business before the committee, it was moved by Clark, seconded by Schmitt that the meeting be adjourned at 4:50 p.m. Ayes: Six. Absent: Cole.
