COUNCIL WORK SESSION
July 21, 2003

Members present: Mayor Rooff, Kincaid, Welper, Clark, Jordan, Hurley, Getty.
Members absent: Greenwood.
Moved by Jordan, seconded by Hurley that the Agenda, as proposed, be approved. Ayes: Six.
Absent: Greenwood. Motion carried.
The request of Lockard Development Inc., Hurst Holding Co. and J & S Realty, LLC to rezone
from "A-1" Agricultural District to "C-2" Commercial District property generally located at the
northwest corner of Tower Park Drive and Johnathan Lane, just west of the new Lincoln Savings
Bank in the Tower Park area for construction of an auto dealership was reviewed. The Planning,
Programming and Zoning Commission recommended 5 to 4 (with 1 abstention) to approve the
request. Staff had recommended denial based on concerns of this type of commercial use in this
area, as the Comprehensive Plan designates it "Business Park" and staff had concerns with the
design of the building being compatible with other existing buildings in the area. Staff would
recommend that the council, if approving the request, consider the following possible conditions:
1. That the building be constructed with an exterior finish to match the brick work,
concrete style, or EFIS system to make it look similar to other existing buildings.
2. That no intercom system be installed or utilized at the site, instead using cell phones,
etc. as described at the Planning Commission meeting.
The submitted site plan showed a metal building, which would not necessarily be incompatible if
coated with an EFIS system or similar method to create an appearance similar to the multiple
brick facades on other structures in this area. The City of Waterloo Economic Development Plan
showcases this South Waterloo Business Park as one of the premiere locations in the Cedar
Valley, and staff believes the design of the buildings should reflect that image.
Ken Lockard reported that the developer has agreed that there will be no intercom system, but
they will use a pager system. They also agreed to more planting than normal and to change the
building to blend in better with the existing buildings. Mr. Lockard reported it is very likely the
business will build at this location, but there is no room for expansion capacity in the future.
This is a great location and once the Ansborough Avenue Interchange is built that will help with
the traffic. Mr. Lockard stated he believes that this use does serve the public and offices for
people working in this area.
Councilperson Hurley stated that when the council discussed the Ansborough Avenue
Interchange, they looked at 4th Street to Kimball Avenue as being used for business offices, and
now we are looking at a new car dealership. Councilperson Hurley stated that staff
recommended denial and Planning, Programming and Zoning Commission approved. Now city
staff is saying that if the council approves the request they would like the two conditions attached
to the rezoning.
Mr. Lockard stated that the business owner is willing to go the extra mile and do those things and
the council should make the two conditions part of the requirements. Mr. Lockard stated there is
probably more traffic in and out of the bank than there will be at the car lot.
Councilperson Hurley asked if the intersection at Tower Park and San Marnan Drive will require
changes such as traffic lights. Mr. Lockard responded that the intersection will probably need
them in the future.
With no further business before the council, it was moved by Getty, seconded by Jordan that the
meeting be adjourned at 4:19 p.m. Ayes: Six. Absent: Greenwood. Motion carried.
