Members absent: Greenwood. Moved by Jordan, seconded by Welper that the Agenda, as proposed, be approved. Ayes: Six. Absent: Greenwood. Motion carried. Frank Magsamen, Emergency Management Coordinator, gave a presentation on the State Wide Mutual Aid Compact. The purpose of the State Wide Mutual Aid Compact is to save lives and address major disasters. The State Wide Mutual Aid Compact is under 29C.22 legislation within the State of Iowa. The legislation does not replace existing agreements and does not alter the operation of local jurisdictions. Participating jurisdictions include: cities, counties, townships and other political subdivisions. Currently 70 entities in the state have signed the compact. The compact provides for mutual assistance between the participating governments in managing any emergency or disaster that is declared by the governor or mayor in accordance with a countywide comprehensive emergency operations plan. The authorized representative of a participating government may request assistance of another participating government by contacting the authorized representative, or by contacting the emergency management division of the State Department of Public Defense. Licenses and peilciits are required by the compact for any person responding to a participating government. Officers or employees of a participating government rendering aid in another participating government jurisdiction are considered agents of the requesting participating government for tort liability and immunity purposes and shall not be liable on account of any act or omission in good faith. Supplementary Agreements are allowed, including provisions for evacuations and reception of injured and other persons and the exchange of medical, fire, police, public utility, welfare, transportation and communications personnel and equipment and supplies. Each participating government must provide workers compensation and death benefits to injured members of the emergency forces. The participating government is entitled to reimbursement by the government receiving the emergency aid for any loss or damage to or expense incurred in the operation of any equipment and providing any service in answering a request for aid and the costs incurred in connection with the requests. Plans for evacuation and reception of portions of the civilian population as the result of any emergency or disaster shall be worked out and maintained between the participating governments and the emergency management or services directors of the various jurisdictions. The compact becomes operative immediately upon its adoption by resolution or ordinance of the governing bodies of any two political subdivision. Any participating government may withdraw from the compact by adopting an ordinance or resolution repealing the compact, but the withdrawal cannot take effect until thirty days after the governing body of the withdrawing participating government has given notice in writing of the withdrawal to the administrator of the emergency management division. The State Wide Mutual Aid Compact is on tonight's council agenda for approval.
