COUNCIL WORK SESSION

Members present: Mayor Rooff, Kincaid, Welper, Greenwood, Jordan, Hurley, Getty, Clark.
Moved by Jordan, seconded by Welper that the Agenda, as proposed, be approved. Ayes: Six.
Absent: Clark. Motion carried.
Mayor Rooff stated that the purpose of the work session is to review the request from Lockard
Development on behalf of property owners to rezone from "A-1" Agricultural District to "R-4,R-
P" Planned Multiple Residence District, "C-P" Planned Commercial District and `B-P" Business
Park District for property generally described as West 4th to Kimball Avenue north of Highway
20 and Ansborough Avenue to Kimball Avenue 1/4 mile south of Highway 20.
Noel Anderson, Assistant City Planner, described the following uses for the above districts:
"R-4,R-P" Professional office and residential
"C-P" Professional office, compatible commercial
"B-P" Professional office, commercial and compatible light industrial
Mr. Anderson reported that the first request submitted to the Planning, Programming and Zoning
Commission included six "C-P" designations. The property owners north of San Martian Drive
were concerned with the six "C-P" designations. Staff, Planning, Programming and Zoning
Commission members and property owner representatives met twice with some of the residents
north of San Marnan to create the 2nd plan, which included three "C-P" designations. The 2nd
plan eliminated some of the "C-P" districts along San Marnan due to the neighbors' concerns
regarding noise on San Marnan Drive and traffic congestion, the visibility of the businesses and
lights. The Planning, Programming and Zoning Commission recommended approval after
amending the plan to remove the two easterly most "C-P" designations along San Marnan Drive.
The easterly most location would be straight across the street from the new Lincoln Savings
Bank, the second would be at the 114 mile location.
Fred Debe stated that the original request submitted included six "C-P" designations, but after
meetings with the property owners a compromise was reached for three "C-P" designations and
submitted to the Planning, Programming and Zoning Commission. The Planning, Programming
and Zoning Commission voted to eliminate all of the "C-P" designations except for the one on
the easterly side of Ansborough.
Bob Fahr stated that they talked about eliminating the center four "C-P" designations and having
them basically on Johnathan and Ansborough. On September 9, 2003, the Planning,
Programming and Zoning Commission approved just one "C-P" designations on Ansborough,
and the citizens support this decision.
Maxine Barrows stated there was a reason why the Planning, Programming and Zoning
Commission removed all but the one designation on Ansborough because this will allow
residents to look at each site plan as submitted.
Mr. Fahr stated they are favor of the "B-P" District, but they do not want any more fast food
places, cleaners and doctors office.
Mr. Debe stated that from a development standpoint Lockard Development needs the option to
move along without coming back to the city. The plan has been reduced from six "C-P"
designations to three "C-P" designations, and the developers wish to keep it that and to have the
plan approved as submitted.
Mr. Anderson reported that his understanding is that if the council wants to approve the request
and not accept the Planning, Programming and Zoning Commission's recommendation, it will
come to the city council as a denial of their recommendation.

Mayor Rooff asked if the council passes what is brought to them from the Planning,
Programming and Zoning Commission, what will Mr. Lockard do. Mr. Debe responded that if
the council approves the rezoning with only one "C-P" designation, they will withdraw their
request.
Ms. Barrows stated she has asked Planning staff for a corrected copy of the map with just one
"C-P" designation. Ms. Barrows stated if the council doesn't listen to the Planning,
Programming and Zoning Commission, they put the commission at risk because the council is
saying what good is that commission. Ms. Barrows stated the citizens presented valid points to
the Planning, Programming and Zoning Commission.
Mr. Debe stated that the Planning, Programming and Zoning Commission voted on a plan that
does not exist, and they did not ask the developers if they agree with the amended plan.
Councilperson Clark stated he does not feel that three "C-P" designations are too many.
Councilperson Hurley stated he was present at the Planning, Programming and Zoning
Commission meeting, and the residents spoke stating their concerns, but there was agreement on
three "C-P" designations. Commissioner Jordan made the motion to reduce the "C-P" to one.
Mr. Smith from Lockard Development said once again we have taken steps that are unfriendly to
developers because this amendment would make them have to come back each time.
Mr. Debe stated that each of the designations require site plan approval by the city council.
Mayor Rooff stated that every time the Planning, Programming and Zoning Commission makes a
decision that developers do not like, the request comes before the council to override their
decision.
Councilperson Getty stated that the council may need to send this request back to the Planning,
Programming and Zoning Commission to ask why they voted for only one "C-P" designation.
Ms. Barrows reported that not all the residents were infoinied of the rezoning because the city is
only required to notify residents within 250 feet of the rezoning request, and she feels as a
courtesy that everyone along this area be informed. Ms. Barrows stated that the number of curb
cuts are a concern because the traffic will require a few traffic lights.
Mr. Fahr stated that the reports show that traffic on San Marnan will increase from 10,000
vehicles per day to 14,000 to 15,000 vehicles per day, and that noise is unbearable now Mr. Fahr
stated they are opposed to commercialization along this area.
Mayor Rooff stated that this area is very critical to the city's development.
Councilperson Greenwood suggested that one "C-P" designation be put on Johnathan and one
west of Tower Park.
Mr. Debe stated that this development includes 320 acres with only 15 acres designated as "C-
y".
Councilpersons Welper and Kincaid want to hear from the Planning, Programming and Zoning
Commission as to why they amended the request with only one "C-P" designation.
Councilperson Clark stated he agrees with Mr. Debe but would like to hear from Planning and
Zoning. Councilperson Jordan asked that this be referred back to the Planning, Programming
and Zoning Commission. Councilperson Hurley agreed with the compromise of three "C-P"
designations. Councilperson Getty stated he would vote with the recommendation of the
Planning, Programming and Zoning Commission.
Ms. Barrows stated they have spent considerable time driving San Marnan and looking at the
services available to this development.

Mr. Debe stated he does not believe the developers will say two "C-P" designations are
acceptable.
Ms. Barrows requested a map of what the Planning, Programming and Zoning Commission
approved.
Mayor Rooff will schedule a council work session for October 9, 2003 to discuss this rezoning
with members of the Planning, Programming and Zoning Commission.
With no further business before the council, it was moved by Getty, seconded by Jordan that the
meeting be adjourned at 4:30 p.m. Ayes: Seven. Motion carried.
