Members present: Berry, Welper, Greenwood, Clark, Jordan, Hurley, Getty.
Moved by Jordan, seconded by Berry that the Agenda, as proposed, be approved. Ayes: Seven.
Motion carried.
Jack Fellenzer, Contract Compliance Officer, reviewed the proposed Contract Compliance
Program. Mr. Fellenzer stated that many people were involved in creating the proposed
program, including city staff, contractors, subcontractors, and state and federal staff.
Mr. Fellenzer stated that in 1980 the Federal DOT established its first Disadvantaged Business
Enterprise (DBE) Program, and in 1983 additions were made to the DBE Program. The Civil
Rights Act of 1964 established EEO Policies and Affirmative Action Programs. In 1976, the
council adopted Resolution No. 24664 establishing the Affirmative Action Program for Minority
Contractors. In 1978 the city hired its first Contract Compliance Officer. In 1979 the council
adopted Resolution No. 25514 establishing the Contractor Advisory Committee. In 1981 the
council adopted Resolution No. 1981-49 approving the Affirmative Action Agreement between
HUD and the city. The council adopted Resolution No. 1984-142 establishing MBE, WBE,
DBE Contracting Authority Committee. In 1985 revisions were made to the city's Affirmative
Action Program. In 1986 the city adopted the Contract Compliance Program currently in use. In
1990 the Mayor's Minority Contractors meetings ceased, but the program continued as designed.
In 2000 - 2001 the goals and objectives for the Contract Compliance Program were re-
established. The city currently has a Minority Contractors Quarterly Newsletter and a Contract
Compliance Website. The Mayor's monthly Minority Contractor's meetings resumed in May
2001. The city received input from prime and minority contractors. There were meetings with
state and federal staff. The committee reviewed other Iowa cities programs. Waterloo is the
only city in the state with a 5 percent MBE goal and 1 percent WBE goal.
Community Development Projects with DBE Participation were as follows:
Housing Rehabilitation Project - FY 2000 - 29% FY 2001 - 69%
Demolition Projects - FY 2000 - 2001 - 12 %
The Contract Compliance Program's purpose is to act as an impetus for increasing the
participation of minority and women business enterprise in city awarded construction and
procurement contracts and to serve as a stimulus to help local MBE/WBE's grow and eventually
become mainstream contractors and subcontractors. The revised program includes: a Goal
Setting Committee, documentation submitted with bids, demonstration of "good -faith efforts",
review of prime contractors efforts, and an Administrative Reconsideration Committee. The
revised program includes: contracting procedures, and CCO forms.
The ongoing objectives of the programs are as follows:
Establish initiatives in all city related contracts
To seek cooperation with other Cedar Valley area municipalities
To develop ties with private sector construction contractors and developers
To provide assistance with job training programs and referrals
Be a source for current information of federal and state rules and regulations, forms and
contacts.
To monitor all activities pertaining to city policies regarding contracts and contractors.
Councilperson Berry commended Mr. Fellenzer for his hard work putting this program together
and all the prime contractors and minority contractors working in a positive way to improve the
city's current program.

Councilperson Berry submitted revisions to the program from the Cedar Valley Minority
Contractors Association. Councilperson Berry asked the council to review these revisions and
offer further recommendations to Mr. Fellenzer.
Councilperson Hurley stated that minority contractors gave input into the proposed program and
asked why the council is just getting the revisions tonight. Councilperson Berry responded that
the group met yesterday, and they felt it was important to bring the revisions to the council to
allow time for the council to review them before a final decision is made.
Councilperson Getty asked Mr. Fellenzer, the committee and minority contractors to review the
revisions from the Cedar Valley Minority Contractors Association to see if it is feasible to
combine them with the proposed program and bring back to the council.
Martin Culpepper stated that there are still a bunch of issues that need clarification and
elimination. Mr. Culpepper stated that the Cedar Valley Minority Contractors Association added
percentages and eliminated items that would not work.
Councilperson Berry stated that over a year ago, it appeared minority contractors were getting
work outside of the city, but not any work from our city. Mayor Rooff asked Councilperson
Berry and Jack Fellenzer to form a committee to look at the issues, and they worked with the
prime contractors and minority contractors in an effort to move forward and come back with a
workable solution.
With no further business before the council, it was moved by Jordan, seconded by Hurley that the
meeting be adjourned at 5:21 p.m. Ayes: Seven. Motion carried.
