Members absent: Getty. Moved by Jordan, seconded by Welper that the Agenda, as proposed, be approved. Ayes: Five. Absent: Berry, Getty. Motion carried. The council reviewed the corrective action for the recreational trail located along the north side of Martin Luther King Jr. Drive. The recreational trail along the north side of Martin Luther King Jr. Drive is non-compliance with Iowa Department of Transportation specifications relating to smoothness. The city's consultant, Earth Tech, Inc., has developed a corrective action which includes removal and replacement of twenty-five 10-feet sections of trail that is in non- compliance and considered as defective work. The corrective action also includes 1,160 feet of trail that is being considered as reasonably acceptable, which means acceptance with price adjustment but will remain in place. Earth Tech, Inc. derived a price adjustment based on comparable price adjustments on other Iowa Department of Transportation projects. A total price adjustment of $7,540.00 was calculated. In lieu of price adjustment, it is being proposed that the contractor complete the initial construction of a Trail Head near the Idaho intersection. This work would include grading and earthwork of the Trail Head as well as paving a driveway off of Idaho Street. Berry now present at 4:05 p.m. City Engineer Eric Thorson stated that the contractor had a problem with the paving machine, which was replaced after this project. Mr. Thorson reported that the rough pavement is noticed at the worst location when bicycling and rollerblading. Councilperson Hurley asked if the city would have eventually built the Trail Head. Paul Huting, Leisure Service Director, responded that we would have done this project a few years from now. Mr. Huting stated this is a good location for a Trail Head as this is city -owned property. Mr. Thorson stated that a lot of the rest of the work will be completed by Leisure Services, such as a parking lot and rest area. Councilperson Clark asked why wouldn't the city require Rampart to replace all of the defective sections. Mr. Thorson responded that would require repaving of the whole project, when they met all of the requirements, but smoothness. Councilperson Berry stated she feels Rampart should replace all of the defective work. A representative from Earth Tech stated that they tested for smoothness, and the only thing to compare with are sidewalks, which are not the same size. The Iowa Department of Transportation has developed new specifications for bikeways, and those specifications were used to come up with this result. Mayor Rooff asked why we would put the Trail Head in when there are other areas that the trail users have discussed with the city. Mr. Huting responded that there is not a good area for users to park their vehicles for access to the trails on the north side of Waterloo. Also, the funding source cannot be moved out of the project area. Mr. Thorson stated that citizens did bring up lack of access to the trails on this side of the city.
