Moved by Jordan, seconded by Gronen that the Agenda, as proposed, be approved. Ayes: Seven. Motion carried. Fire Chief Frank Magsamen presented proposed changes to Chapter 14, Fire Prevention and Protection, of the Waterloo Code of Ordinances. Sec. 14-12, Violation and Penalty, changes the violation of Chapter 14 from a simple misdemeanor to a municipal infraction. The civil penalty for a municipal infraction will be as follows: First offense, two hundred dollars ($200.00) Second offense, five hundred dollars ($500.00) Third or more offense, seven hundred fifty dollars ($750.00) Sec. 14-51, Annual Inspections, includes new language which allows the fire marshal, fire inspectors, or fire officers, upon presentation of credential, access and entry to premises for purposes of inspection. Denial of entry or interference with the inspection by any person will constitute a municipal infraction. The current code allows for annual inspection but does not specifically address the issue of allowing the inspectors into the premises. Sec. 14-58, Permits and certificates required. An annual fire prevention inspection certificate is required for all structures except residential. The new language makes it a municipal infraction for failure to obtain a certificate. It was the consensus of the council that the proposed amendments to Chapter 14, Fire Prevention and Protection, be placed on the council agenda of March 19, 2001. With no further business before the council, it was moved by Jordan, seconded by Murphy that the meeting be adjourned at 4:28 p.m. Ayes: Seven. Motion carried. Nancy Eckert City Clerk
