Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry. Invocation by: Councilperson Jerry Anders. Pledge of Allegiance: Jeff Robbins, Director of Aviation. ORAL PRESENTATIONS 115306 - Mayor Rooff thanked the Black Hawk County Supervisors for their approval of the $10 million bond issuance in support of the Downtown Riverfront Renaissance Plan. Mayor Rooff thanked Dan Watters and the Waterloo Development Corporation for all their work on the Plan. Mayor Rooff commented that the $10 million bond money from Black Hawk County will make all the difference with the Vision Iowa Board. Mayor Rooff stated this plan answers the question of what we will do for our future and our kids' future. Getty/Jordan that the above oral comments be received and placed on file. Ayes: Seven. Motion carried. 115307 - Getty/Jordan that the Agenda, as amended to delete Item 6, for the Regular Session on Tuesday, May 29, 2001, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. 115308 - Jordan/Berry that the Minutes, as proposed, for the Regular Session on Monday, May 21, 2001, at 5:30 p.m. be accepted and approved. Ayes: Seven. Motion carried. Presentation of Certificate of Appreciation and trophy in recognition of the City's help with the Dirt'N the House BMX bicycle track. HEARINGS 115309 - Jordan/Murphy that proof of publication of notice of public hearing on amendments to the F.Y. 2001 Budget, as published in the Waterloo Courier on May 17, 2001, be received and placed on file. Ayes: Seven. Motion carried. 115310 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Jordan/Gronen that the hearing be closed and oral and written comments be received and placed on file. Ayes: Seven. Motion carried. 115311 - Jordan/Murphy that "Resolution approving said F.Y. 2001 Budget amendments", be adopted and City Clerk instructed to notify Black Hawk County Auditor of same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-255. UNFINISHED BUSINESS 115312 - Mayor Rooff read a letter from Jack Fellenzer, Contract Compliance Officer, regarding use of MBE/WBE contractors on this project. Mr. Fellenzer reported that the WBE goal of 1 percent for this contract was met with 12 percent participation, and the MBE goal of 5 percent of this contract was not met with 3.4 percent MBE participation. Mr. Fellenzer feels that due to the unusual nature of the work required to construct the project that Borwig Building Services, Inc. has made a "good faith effort" to include local Certified MBE contractors, based on existing available workforce, and Borwig Building Services has met the requirements of the current MBE/WBE Contract Compliance Program. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-256. PETITIONS FROM PUBLIC 115313 - Anders/Jordan that communication from City Clerk transmitting request of Daryl and Meri Kay Chase, 555 W. Wellington Street, for a variance to the Noise Ordinance on June 2, 2001, from 7:00 p.m. to 11:00 p.m. in conjunction with a band performing in their backyard facing the woods, cemetery and Highway 63, together with recommendation of approval of Chief of Police, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-257. 115314 - Anders/Jordan that communication from City Engineer transmitting request of Leslie L. Keilholtz for a waiver for an asphalt driveway to be located at 1341 Black Hawk Road, together with recommendation of approval, be received, placed on filed and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-258. DOCUMENTS 115315 - Getty/Anders that communication !from Building Official transmitting Contracts, Bonds and Certificates of Insurance in the amount of $489,483.00 from Borwig Building Service, Inc., of Waterloo, Iowa, in conjunction with West 5th Street Parking Ramp Improvements be received, placed on file and "Resolution approving said documents", be adopted and Mayor and City Clerk authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-259. ORDINANCES TO BE ADOPTED 115316 - Krizek/Jordan that "an Ordinance amending the 2001 Code of Ordinances of the City of Waterloo, Iowa, by repealing the definition of `Unlicensed Vehicle' of Subsection A of Section 4-4-7, Junk Motor Vehicles, of Chapter 4, Litter Control, of Title 4, Public Health and Safety; and enacting in lieu thereof a new definition of `Unlicensed Vehicle' of Subsection A of Section 4-4-7, Junk Motor Vehicles, of Chapter 4, Litter Control, of Title 4, Public Health and Safety (requiring unlicensed vehicles to be in an enclosed building)", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 115317 - Murphy/Jordan that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 115318 - Jordan/Krizek that "an Ordinance amending the 2001 Code of Ordinances of the City of Waterloo, Iowa, by repealing the definition of `Unlicensed Vehicle' of Subsection A of Section 4-4-7, Junk Motor Vehicles, of Chapter 4, Litter Control, of Title 4, Public Health and Safety; and enacting in lieu thereof a new definition of `Unlicensed Vehicle' of Subsection A of Section 4-4-7, Junk Motor Vehicles, of Chapter 4, Litter Control, of Title 4, Public Health and Safety (requiring unlicensed vehicles to be in an enclosed building)", be considered and passed for the second and third times and adopted. Ordinance adopted and upon approval by Mayor assigned No. 4480. 115320 - Getty/Berry that "Resolution authorizing sale and conveyance of the north -south alley abutting property generally located at 710 Broadway Street for $100.00 to Hope Missionary Baptist Church", be adopted and City Attorney instructed to prepare and deliver deed accordingly. Ayes: Five. Nays: Murphy, Gronen. Resolution adopted and upon approval by Mayor assigned No. 2001-260. 115321 - Jordan/Murphy that "an Ordinance amending the 2001 Code of Ordinances of the City of Waterloo, Iowa, by repealing Subsection A, Appointments; Term, of Section 2-8- 2, Composition and Membership, and Subsection B, Quorum, of Section 2-8-3, Meetings, of Chapter 8, Cultural and Arts Commission, of Title 2, Boards and Commissions; and enacting in lieu thereof new Subsection A, Appointments; Term, of Section 2-8-2, Composition and Membership, and Subsection B, Quorum, of Section 2-8-3, Meetings, of Chapter 8, Cultural and Arts Commission, of Title 2, Boards and Commissions (increasing number of commissioners from seven to eleven)", be received, placed on file, considered and passed for the first time. Motion carried. 115323 - Murphy/Gronen that "an Ordinance amending the 2001 Code of Ordinances of. the City of Waterloo, Iowa, by repealing Subsection A, Appointments; Term, of Section 2-8- 2, Composition and Membership, and Subsection B, Quorum, of Section 2-8-3, Meetings, of Chapter 8, Cultural and Arts Commission, of Title 2, Boards and Commissions; and enacting in lieu thereof new Subsection A, Appointments; Term, of Section 2-8-2, Composition and Membership, and Subsection B, Quorum, of Section 2-8-3, Meetings, of Chapter 8, Cultural and Arts Commission, of Title 2, Boards and Commissions (increasing number of commissioners from seven to eleven)", be considered and passed for the second and third times and adopted. Ordinance adopted and upon approval by Mayor assigned No. 4481. 115324 - Berry/Anders that "an Ordinance amending the 2001 Code of Ordinances of the City of Waterloo, Iowa, as it pertains to changing the name of Sanitation and Water Pollution/Flood Control Department to Waste Management Services Department", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 115325 - Getty/Krizek that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 115326 - Jordan/Berry that "an Ordinance amending the 2001 Code of Ordinances of the City of Waterloo, Iowa, as it pertains to changing the name of Sanitation and Water Pollution/Flood Control Department to Waste Management Services Department", be considered and passed for the second and third times and adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4482. May 29, 2001 Page 4 BILLS PAYMENT 115327 - Krizek that "Resolution approving Schedule AP640, pp. 1-87, dated May 29, 2001, in the amount of $988,740.95, a copy of which is on file in the City Clerk's Office", be adopted, together with recommendation of approval of the Finance Committee. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-261. NEW BUSINESS 115328 - Anders/Jordan to instruct City Engineer to prepare plans, specifications, form of contract, etc. in conjunction with Sergeant Road -Cedar Prairie Trail Connection, be received, placed on file and approved. Ayes: Seven. Motion carried. 115329 - Jordan/Murphy that plans, specifications, form of contract, etc. in conjunction with Sergeant Road -Cedar Prairie Trail Connection, be received and placed on file. Ayes: Seven. Motion carried. 115330 - Murphy/Jordan that "Resolution preliminarily approving plans, specifications, form of contract, etc. in conjunction with above described project", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-262. 115331 - Krizek/Jordan that "Resolution setting date of hearing on plans, specifications, form of contract, etc. as June 11, 2001, at 5:30 p.m. in the City Hall Council Chambers on the above described project", be adopted and City Clerk instructed to publish notice of same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-263. TRAVEL REQUESTS 115332 - Gronen/Anders that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Emily Kuntz, Internal Auditor, to attend continuing education course to maintain CPA status in Iowa City, Iowa, on June 12, 2001, with costs not to exceed $245.00. 2. Cliff Caughron, Sue Holmes, Willie Keller and Robert Greenlee, Police Dare Student Resource Officers, to attend annual DARE Conference in Council Bluffs, Iowa, on July 15-17, 2001, with costs not to exceed $766.00, including use of city vehicle.
