Moved by Jordan, seconded by Murphy that the Agenda, as proposed, be approved. Ayes: Seven. Motion carried. The request of Tim and Bob Brustkern to voluntarily annex approximately 55 acres generally lying southeast of LaPorte Road, north of where East Orange Road would be extended and west of Foulk Road to develop for one and two family home lots and a manufactured home subdivision was reviewed. The request was reviewed by the Planning, Programming and Zoning Commission at their May 2, 2000 meeting, and they recommended denial. At the Planning Commission meeting a number of residents were opposed for the following reasons: 1. Drainage throughout the area - sanitary sewer problems and overall flooding problems. 2. Urban sprawl issues and availability of lots within current city limits 3. Not a smart development based on taxation system applied to mobile home parks. 4. Capability of school system (Orange School) to handle population load in the area. The area consists of approximately 55 acres lying southeast of LaPorte Road, north of where East Orange Road would be extended and west of Foulk Road. Bob Brustkern, Elizabeth Marx and Mark Gill have proposed to voluntarily annex the above described land. According to State of Iowa annexation laws, the council is required to pass a resolution approving the property owner's petition and file copies of the owner's petition, a plat and approving resolution along with a petition by the city with the Secretary of State. Prior to council submission, the railroad is required to be notified by certified mail. Mr. Brustkern intends to develop a portion of the annexed area for one and two family home lots along Foulk Road and a larger portion of the area for a manufactured home subdivision. The Long Range Land Use Plan designates the area for low density residential, which could be accomplished through the size of the lots. There are utilities within the area that would require extension by the developer. According to Zoning Ordinance 2479, property annexed will be zoned "A-1" Agricultural District. The applicant would need to go through the zoning process for development of the lots. Tim and Bob Brustkern submitted a letter and a preliminary list of guidelines that they feel would aid in the development and maintenance of premier manufactured homes in the community. The Brustkerns were involved in the construction of the Cedar Knoll Mobile Home Park as well as Southview Estates Mobile Home Park. Fred Debe reviewed the annexation request and the proposed use of the land. Mr. Debe reported that there are drainage areas between LaPorte Road and Foulk Road. Mr. Debe stated that if the property were annexed, the developers would build the sanitary and storm sewers and install water in the area. They would deed to the city any part of the infrastructure not needed as part of the subdivision. Mr. Debe reported that the lots are 60' x 100'. Mr. Debe stated that all development in the subdivision would be the responsibility of the developers, including streets, plowing, etc. Mr. Debe stated that all the manufactured homes would have horizontal siding, sloped shingled roofs, no basement, aluminum skirting and would be set on frost footings. The residents would own the manufactured home and lease the property. Mr. Debe stated that there are eight large lots along Foulk Road that could be used to build stick homes. Councilperson Getty requested that a bus tour be scheduled for the council to visit the proposed area to be annexed. Council Work Session October 9, 2000 Page 2 The resident at 5925 Foulk Road asked the council to take a good look at the request. There is a mobile park by Highway 218 which creates problems for the residents because of the running water, and he believes additional concrete will increase the water problem. He is concerned that there will be a problem with the increased traffic on Foulk Road, and is concerned with the affect the subdivision will have on Orange School. He stated that the manufactured homes are built elsewhere, not by local contractors, and brought into the community. The resident stated that we shouldn't look for a quick fix. He stated manufactured homes do not appreciate in value. The resident at 5142 Foulk Road stated she was concerned with the affect 139 new homes will have on the sanitary sewer system. Dennis Colsch, 6200 Foulk Road, stated that he cleaned up 18 wheel barrels full of corn from his property. Mr. Colsch stated that he had water problems on his property until he waterproofed his basement. Mr. Colsch encouraged the council to look at his property and the drainage problem in the area when they take their tour. Mr. Colsch stated that all the residents along Cedar Terrace and Foulk Road oppose this development. A council bus tour will be scheduled to review the proposed annexation and development. With no further business before the council, it was moved by Getty, seconded by Berry that the meeting be adjourned at 5:00 p.m. Ayes: Seven. Motion carried. Nancy Eckert City Clerk •
