Moved by Jordan, seconded by Berry that the Agenda, as proposed, be approved. Ayes: Seven. Motion carried. Fire Rescue Chief Frank Magsamen reviewed the revisions of the Fire Lane/Emergency Vehicle Lane Ordinance. Chief Magsamen recommended that any person violating the ordinance be guilty of a municipal infraction and be fined not more than $50.00. Chief Magsamen reported that Cedar Falls has a fine of $30.00, Cedar Rapids is $100.00, Iowa City is $5.00 and Sioux City is $5.00. Chief Magsamen stated that members of Fire Rescue and the Police Department will be authorized to write tickets for violations. Chief Magsamen stated that a business can request that a fire lane/emergency vehicle lane be posted at their business or the Fire Chief can instruct a business to post the sign if it is determined that it is a public safety issue. The business will have to pay for the signage. The fire lane/emergency vehicle lane will be posted with metal signs that state no parking is allowed and violators are subject to towing and a citation. Chief Magsamen stated that he has had reports from ambulance and fire truck drivers that the entrance to the buildings are blocked, and that a few businesses have asked for the fire lane. Chief Magsamen stated that this is public safety driven. Councilperson Murphy stated that he is worried about getting into neighborhood wars that we already have with buses, etc. Councilperson Gronen stated that perhaps we should include Code Enforcement Officers as having authority to write tickets for violation of the ordinance. Chief Magsamen stated that we could remove the areas zoned R-1 and R-2 from the ordinance. Councilperson Krizek stated that she agrees that for safety reasons there are areas that need the lanes. Moved by Anders, seconded by Krizek that the Fire Lane/Emergency Vehicle Lane Ordinance be forwarded to the full council and placed on the council agenda next week for the first reading. Ayes: Seven. Motion carried. Sang-Ki Han, Assistant City Attorney, stated that he recommends that the ordinance have language that the ticket is being written to the owner of the vehicle and that the fine be $50.00, not up to $50.00. Tim Shea, Superintendent of Water Pollution/Flood Control, reviewed Change Order No. 10 for a net increase of $17,890.00 for work to be performed by Fagen, Inc. in conjunction with the Water Pollution Control Facilities, Contract No. 549. The Change Order provides for removal and disposal of existing paint containing lead from surfaces of piping, flanges, pipe supports and walls in the Anaerobic Digester complex. The existence of the lead based material was discovered after the contract for the digester project was awarded to Story Construction Co. Since the lead poses a health hazard to Story's personnel during the demolition phase of the project, the material needs to be removed in locations where cutting through the paint is required as part of the demolition. The abatement work will be assigned to Fagen, Inc. to the extent that it is immediately necessary to avoid delays in the performance of Story's contract. The remainder of the abatement of lead based paint and asbestos necessary to complete the Anaerobic Digester project will be under a separate contract to be sent out for competitive bidding. The change order constitutes 0.09 percent of the original contract and results in a new contract price of $19,272,099.00. The change order is on tonight's council agenda for approval.
