TO
CONSTRUCTION PHASE SERVICES AGREEMENT
WHEREAS, the CITYOF WATERLOO, the OWNER and CLAPSADDLE-GARBER ASSOCIATES, INC.,
the ENGINEER have entered into an agreement dated January 5, 2021 for Construction Phase Services for
the Waterloo Airport Industrial Park, now more commonly referred to as the Waterloo Air and Rail Park,
and
WHEREAS, the project work has exceeded the Final Completion Date of 7/1/2021 for the Sanitary Sewer
Lift Station City ContractNo.983; and
WHEREAS, the ENGINEER has been able to extend services under the existing agreement through
12/17/21 while remaining under the existing Not to Exceed Cost;
WHEREAS, the OWNER now has a contract nearing the total Not to Exceed Cost, preventing remittance
of payment for any additional services needed to complete the contract, desires the Engineer to provide a
schedule of fees for completion of the project,
WHEREAS, the ENGINEER estimates a completion date of 6/3/22 taking into consideration estimates
from the prime contractor and sub -contractors,
WHEREAS, the ENGINEER proposed increase in Not to Exceed Cost shall pro -rate the actual average
weekly expenses through to the end of the new completion date:
$108,000/48 weeks = $2,250/week
Extension from 12/19/21 to 6/3/22 = 24 weeks
Proposed Increase = $2,250/weekx 24 weeks = $54,000
NOW, THEREFORE, the OWNER and ENGINEER agree to amend the AGREEMENT as follows:
1. Under Fees, Task 1 — Construction Phase Services for FY 2020 Leversee Road Lift Station City
Contract No 983, shall be amended as follows

Total INCREASE in Fee for Task 1 shall be $ 54,000.00, amending the TOTAL AMOUNT NOT
TO EXCEED for Task 1 from $108,000.00 to $162,000.00.
