AMENDMENT TO DEVELOPMENT AGREEMENT 319-234-5701 This Amendment to Development Agreement (the "Amendment") is entered into as of February 21 , 2022 by and between Iowa Heartland Habitat for Humanity (the "Company") and the City of Waterloo, Iowa (the "City"). RECITALS A. Company and City are parties to that certain Development Agreement dated as of March 5, 2018 (the "DA") concerning the development of property as described in the Agreement. The DA has been filed in the land records of Black Hawk County as Doc. No. 2018-16602. B. The parties desire to amend the DA to modify the terms as set forth in this Amendment. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the parties agree as follows: 1. Section 6 of the DA is amended to add the following new paragraph E thereto: E. Infill Housing Grant. As provided in the City's infill housing policy, City will pay Company a grant of $5,000.00 with respect to Lots identified on Exhibit "A" as 8913-24-157-003, 8913-24-162-002, 8913-24-303-021 and 8913-24-303-024, within ninety (90) days after Company has obtained a certificate of occupancy for Improvements made upon the Lot and the City has verified that Improvements have been substantially completed. 2. Exhibit "A" to the DA is amended to add the following property: "8913-24- 303-024 — Lot 4 in Block 66, except Parel "B" of Plat of Survey Doc. No. 2019-11752, and the East one-half of Lot 5 in Block 66, Cooley Addition, City of Waterloo, Iowa." 3. Except as modified herein, the DA shall continue unmodified in full force and effect. Terms in this Amendment that are capitalized but not defined herein will have the same meanings herein that are ascribed to them in the DA. The DA and this Q-1 ) 3 Page 2 Amendment shall inure to the benefit of and be binding upon the parties and their respective successors and assigns.
