RESOLUTION APPROVING A REAL ESTATE PURCHASE
AGREEMENT WITH DEERE AND COMPANY, AND
APPROVING DEEDS TO SELL AND DONATE REAL
PROPERTY TO THE CITY OF WATERLOO, FOR THE
ACQUISITION OF PROPERTY LOCATED SOUTHEAST OF
3801 WEST RIDGEWAY AVENUE, FORMERLY THE JOHN
DEERE SUPERVISOR'S CLUB, AT NO COST, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE SAID DOCUMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA
that the Real Estate Purchase Agreement dated May 16, 2022, between Deere and Company and
the City of Waterloo, Iowa, in conjunction with approving deeds to sell and donate real property
to the City of Waterloo, for the acquisition of property located southeast of 3801 West Ridgeway
Avenue, formerly the John Deere Supervisor's Club, and legally described as follows:
THAT PART OF THE WEST 80 ACRES OF THE EAST 155.25 ACRES OF
THE NORTH FRACTIONAL HALF OF SECTION 1, TOWNSHIP 88 NORTH,
RANGE 14 WEST OF THE 5TH P.M., BLACK HAWK COUNTY, IOWA,
LYING WITHIN THE NORTHEAST FRACTIONAL QUARTER OF SECTION
1, TOWNSHIP 88 NORTH, RANGE 14 WEST OF THE 5TH P.M.,
EXCEPTING THEREFROM PARCEL "A" DESCRIBED IN 329 MISC 555.
SUBJECT TO EASEMENTS, RESTRICTIONS AND COVENANTS OF
RECORD.
ALSO KNOWN AS:
A PART OF THE NORTHEAST FRACTIONAL QUARTER OF SECTION 1,
TOWNSHIP 88 NORTH, RANGE 14 WEST OF THE 5TH PRINCIPAL
MERIDIAN COMMENCING AT THE SOUTHWEST CORNER OF THE
NORTHEAST FRACTIONAL QUARTER OF SAID SECTION 1; THENCE
NORTH 89°40'28" EAST ON THE SOUTH LINE OF THE NORTHEAST
FRACTIONAL QUARTER OF SAID SECTION 1, A DISTANCE OF 33 FEET
TO A POINT ON THE PRESENT EAST RIGHT-OF-WAY LINE OF DEWITT
ROAD, SAID POINT BEING THE POINT OF BEGINNING OF THE PARCEL
OF LAND HEREIN DESCRIBED; THENCE CONTINUING NORTH 89°40'28"
EAST ON THE SOUTH LINE OF THE NORTHEAST FRACTIONAL
QUARTER OF SAID SECTION 1, 567 FEET TO A POINT AT THE
SOUTHWEST CORNER OF PARCEL "A" AS SHOWN IN THE SURVEY
DATED APRIL 2, 1998 AND RECORDED APRIL 2, 1998 IN BOOK 329
MISCELLANEOUS RECORDS, AT PAGE 555 IN THE OFFICE OF THE
RECORDER OF BLACK HAWK COUNTY, IOWA; THENCE NORTH
00°05'31" WEST 1020 FEET ALONG A LINE THAT IS PARALLEL WITH
THE WEST LINE OF THE NORTHEAST FRACTIONAL QUARTER OF SAID
SECTION 1; THENCE SOUTH 89°40'28" WEST 567 FEET ALONG A LINE
THAT IS PARALLEL WITH THE SOUTH LINE OF THE NORTHEAST
FRACTIONAL QUARTER OF SAID SECTION 1 TO THE EAST LINE OF
DEWITT ROAD; THENCE SOUTH 00°05'31" EAST, 1020 FEET TO THE
SOUTH LINE OF THE NORTHEAST FRACTIONAL QUARTER OF SAID
SECTION 1 AND THE POINT OF BEGINNING; EXCEPTING THEREFROM
THAT PARCEL PREVIOUSLY CONVEYED TO THE CITY OF WATERLOO
BY DEED DATED JUNE 11, 2001 AND RECORDED AUGUST 9, 2001 IN
BOOK 574 OF LAND DEEDS, AT PAGE 289 IN THE OFFICE OF THE
RECORDER OF BLACK HAWK COUNTY, IOWA.

SUBJECT TO EASEMENTS, RESTRICTIONS AND COVENANTS OF
RECORD.
at no cost to the city, is hereby approved, and the Mayor and City Clerk are authorized
and directed to execute said documents on behalf of the City of Waterloo, Iowa.
