I, Trisha A. Brown , and Chad P. Brown owner(s) of real estate located in the
unincorporated portions of Black Hawk County, Iowa, commonly known as listed below
, and legally described as (and hereinafter referred to as Lot A):
The West 1/2 of the southeast '/4 of the southeast '/4 of Section 15, Township 90 North, Range 11 West of
the Fifth Principle Meridian, Black Hawk County, Iowa.
herein state that I (we) have purchased the adjacent lot, legally described as (and hereinafter referred to
as Lot B):
The East 1/2 of the southeast 1/4 of the southeast '/4 of Section 15, Township 90 North, Range 11 West of
the Fifth Principle Meridian, Black Hawk County, Iowa.
for the purpose of erecting and maintaining a principal dwelling on a Lot of Record as defined by the
Black Hawk County Zoning Ordinance. As a result of said purchase, I (we) herein declare that the
following restrictive covenants shall govern the use of Lot B, which restrictions shall run with the land
and be binding on the successors, heirs and assigns:
1. That Lot B shall not be sold individually or subdivided, as defined by the Black Hawk County
Zoning Ordinance.
2. That so long as the owners, successors, heirs or assigns own both Lot A and Lot B that a principle
dwelling may be erected as permitted by the Black Hawk County Zoning Ordinance.
3. That this restrictive covenant, as mentioned in Paragraph 1, shall not apply if both Lots A and B are
sold as a unified parcel.
4. That these restrictive covenants have been placed on the real property in order to comply with the
requirements of the Zoning Ordinance of Black Hawk County as a Lot of Record.
5. That none of these restrictive covenants shall be rescinded without the express written consent of the
Black Hawk County Zoning Administrator or his/her authorized designee.
