RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE SALE
AND CONVEYANCE OF 1,152 SQUARE FEET OF EXCESS
RIGHT-OF-WAY GENERALLY LOCATED ALONG THE EAST
SIDE OF LOGAN AVENUE TO THE IOWA DEPARTMENT
OF TRANSPORTATION AS APRIL 26, 2010, AT 5:30
P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO,
IOWA, AND INSTRUCTING THE CITY CLERK TO
PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa,
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 5:30 p.m. on the 26th day of April, 2010, for the
purpose of considering and acting upon a proposal to sell and
convey 1,152 square feet of excess right-of-way generally located
along the east side of Logan Avenue to the Iowa Department of
Transportation, and legally described as follows:
A parcel of land situated in part of Lot 39 of Auditor
Rainbows Plat of Bicksler's Addition (vacated), City of
Waterloo, County of Black Hawk, State of Iowa, more
particularly described as follows:
Beginning at the southwest corner of said Tract `E' of
the survey of the North 315.00 feet of said Lot 39,
said survey is recorded in miscellaneous Book 139 Page
441 in the Black Hawk County Recorder's Office; thence
North 89035140" East on the South line of said Tract
`E', 6.26 feet; thence South 34052140" East, 21.86
feet; thence South 22036144" East, 68.80 feet; thence
South 04026'09" East, 37.97 feet to the present
easterly right of way line of Primary Road No. U.S. 63,
also known as East Mullan Avenue; thence North
21059108" West on the present easterly right of way
line of Primary Road No. U.S. 63, also known as East
Mullan Avenue, 128.62 feet to the Point of Beginning.
Containing 1,152 square feet or 0.03 acre, all in the
City of Waterloo, Black Hawk County, Iowa.
Abstracting costs to be covered by the Iowa Department of
Transportation.
Section 2. That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 12th day of April, 2010.
