Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry. Invocation by: Helen Seenster, Koinonia Ministries. Pledge of Allegiance: Michelle Weidner, Chief Financial Officer. ORAL PRESENTATIONS 114923 - Randal Robinson and his wife, Patricia McGivern, asked the council to reconsider the encroachment agreement for a 1' by 96' portion of alley located behind 907 Byron Avenue. Mr. Robinson reported that he was out of town when his request came before the council, and he did not have an opportunity to attend the hearing. Mr. Robinson stated that it was the opinion of all city agencies that his request would have no negative impact on the neighborhood and felt it was an equitable solution. Mayor Rooff stated that the city will research the vote on the Robinsons' request, and that any council member on the prevailing side could ask that this item be reconsidered by the council. Councilperson Gronen stated that as a member of the prevailing side he would be willing to place this item on the council agenda for reconsideration. Jordan/Berry that the above oral comments be received and placed on file. Ayes: Seven. Motion carried. 114924 - Jordan/Murphy that the Agenda, as proposed, for the Regular Session on Monday, March 19, 2001, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. 114925 - Murphy/Jordan that the Minutes, as proposed, for the Regular Session on Monday, March 12, 2001, at 5:30 p.m. and the Special Session on Wednesday, March 14, 2001, at 9:00 a.m. be accepted and approved. Ayes: Seven. Motion carried. HEARINGS 114926 - Anders/Jordan that proof of publication of notice of public hearing on request of: the University of Northern Iowa for a ten-year lease agreement to use the Chicago Great Western Depot building as classroom and office space for UNI -CUE and a Welcome Center, with two five-year renewal periods at an annual lease amount of $72,420, as published in the Waterloo Courier on March 9, 2001, be received and placed on file. Ayes: Seven. Motion carried. 114927 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Jim Walsh, City Attorney, reported that the agreement is for ten years, with two five year extensions. Councilperson Getty noted that there was an original bid from a contractor, and he asked if that would remain the same. Don Temeyer, City Planner, stated that the original contract with Peters Construction of $794,00 will be amended to reflect the use by UNICUE. Mr. Temeyer reported that it is estimated the cost will increase $65,000.00. Mr. Temeyer stated that this will be bid, and the actual cost is estimated at $865,000. Mr. Temeyer stated that a change order will be sent to the council in the future after the lease has been signed by the University of Northern Iowa. Mr. Temeyer stated that the inside of the building was redesigned. Mr. Temeyer reported that there is a $15,000 contingency. March 19, 2001 Page 2 HEARINGS CONTINUED 114928 - Getty/Gronen that "Resolution approving said lease agreement", be adopted and Mayor and City Clerk authorized to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-96. RESOLUTIONS TO BE ADOPTED 114929 - Berry/Jordan that "Resolution approving Quit Claim Deed and disclaimer affidavit to convey to Interstate Brands Corporation property generally located in the Northeast Industrial Park", be adopted and City Attorney instructed to prepare and deliver deed accordingly. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-97. ORDINANCES TO BE ADOPTED 114930 - Jordan/Getty that "an Ordinance amending the 2000 Traffic Code by repealing Subsection (300) Park Lane of Section 551, Parking Prohibited at All Times on Certain Streets; and enacting in lieu thereof a new Subsection (300) Park Lane of Section 551, Parking Prohibited at All Times on Certain Streets (change no parking from the northeast side to the southwest side of Park Lane from West 9`h Street to Fairlane Avenue)", be tabled indefinitely. Ayes: Seven. Motion carried. 114931 - Anders/Jordan that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 14-12, Violation and Penalty, of Article I, In General, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-12, Violation and Penalty, of Article I, In General, of Chapter 14, Fire Prevention and Protection; and repealing Section 14-51, Annual Inspections, and Subsection (a) of Section 14-58, Permits and Certificates Required, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-51, Annual Inspections, and Subsection (a) of Section 14-58, Permits and Certificates Required, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection (establishing penalty for violation and allowing authorized personnel entry to buildings)", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 114932 - Murphy/Gronen that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 114933 - Jordan/Anders that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Section 14-12, Violation and Penalty, of Article I, In General, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-12, Violation and Penalty, of Article I, In General, of Chapter 14, Fire Prevention and Protection; and repealing Section 14-51, Annual Inspections, and Subsection (a) of Section 14-58, Permits and Certificates Required, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection; and enacting in lieu thereof a new Section 14-51, Annual Inspections, and Subsection (a) of Section 14-58, Permits and Certificates Required, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection (establishing penalty for violation and allowing authorized personnel entry to buildings)", be considered and passed for the second and third times and adopted. Ordinance adopted and upon approval by Mayor assigned No. 4461. 114934 - Getty/Jordan that the request of Fereday Heating Company to vacate, sell and convey the alley abutting property generally located at 1010 Broadway Street for $75.00 be tabled for one week. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-98. NEW BUSINESS 114936 - Jordan/Anders to instruct Facilities Maintenance Supervisor to prepare plans, specifications, form of contract, etc. in conjunction with Remodeling of Rooms 10-13 at the Five Sullivan Brothers Convention Center, be received, placed on file and approved. Ayes: Seven. Motion carried. 114937 - Jordan/Murphy that plans, specifications, form of contract, etc. in conjunction with Remodeling of Rooms 10-13 at the Five Sullivan Brothers Convention Center, be received and placed on file. Ayes: Seven. Motion carried. 114938 - Anders/Jordan that "Resolution preliminarily approving plans, specifications, form of contract, etc. in conjunction with above described project", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-99. 114939 - Murphy/Gronen that "Resolution setting date of hearing on plans, specifications, form of contract, etc. as April 2, 2001, at 5:30 p.m. in the City Hall Council Chambers and taking of bids on the above described project", be adopted and City Clerk instructed to publish notice of same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2001-100. TRAVEL REQUESTS 114940 - Berry/Jordan that the following travel requests, with expenses not to exceed amount shown, be received, placed on file and approved: 1. Steve Grimm and Ralph Baracz, Fire Instructors, to teach 40 -hour technician class for Fisher Controls in Marshalltown, Iowa, on March 25-30, 2001, with costs not to exceed $835.00. 2. Jeffrey Robbins, Director of Aviation, and Kim Bakker, Assistant Director of Aviation, to attend 18th Annual Airports Conference in Kansas City, Missouri, on May 1-2, 2001, with costs not to exceed $955.00. 3. Jeffrey Robbins, Director of Aviation, to attend Cedar Valley Coalition in Washington, D.C., on March 27-29, 2001, with costs not to exceed $1,736.00. 4. Jeffrey Robbins, Director of Aviation, to attend FAA Terminal Conceptual Plan meeting in Kansas City, Missouri, on March 22, 2001, with costs not to exceed $216.50. 5.
